In this paper I intend to give a brief account of the context, causes, structure, aims and dynamic of what I decided to label the Romanian ‘monarchical constitutionalism without octroy’, as a subspecies of the monarchical constitutionalism. This chapter explores the notion of sovereignty and the limits of state power in the framework of criminal justice. It is not an easy enterprise to counter terrorism while respecting the rule of law and guaranteeing the security of citizens to the maximum extent possible without violating their fundamental rights. Theoretically, modern constitutionalism emerged to protect citizens from political abuses of power. In practice, however, fundamental rights are not always fully respected since the state is often tempted to exercise its power beyond legal boundaries. With a courageous judgment, the Constitutional Court extends the application scope of art. 25, par. 2, Cost. in the criminal enforcement sector. Censoring the living law, the Court states the prohibition of the retroactivity of the measures more afflictive introduced by law no. 3 of 2019 to convicts who committed the fact before its entry into force. The Author, after dwelling on the new paradigm of "European legality", retraces the salient passages of the decision, from which it draws the innovative message of the Judge of the laws.

The Italian Constitutional Court (141/2019) rejected the issue on the constitutional legitimacy of the crimes of "recruitment" and "aiding and abetting" prostitution, as proposed by the Court of Appeal of Bari. Nevertheless, the causal links between the behavior of facilitating prostitution and the dangers to freedom, security and dignity of the prostitutes are questionable.

Constitutional rules and competitive politics: their effects on secessionism

Albert Breton and Pierre Salmon argue that the effects of constitutiona l rules depend on the nature of political competition and on some meta-rules that contain procedures regulating the application and the modification of constitutiona l rules.
