2010

Review of the monograph by C. Giuffrida, who entrusts this study with a personal interpretation of some relevant aspects that characterised the late antique world. The volume is divided into four parts: the first on the creation of a new ruling class; the second on the strategy to strengthen imperial power; the third on Theodosius I and the difficult control of the West; the fourth on the new behavioural paradigms at the court of the Theodosians and in particular on the political role of the Augustae.

Is there a latin american child migration law? An analysis of the ‘Advisory Opinion n. 21 on the rights of child migrants’ rendered by the Inter-Amer…

2019

In 2014, in response to the request of the Southern Cone countries, the Inter-American Court of Human Rights issued an Advisory Opinion on the rights of migrant children in an attempt to emphasize the minimum guarantees that the countries of the region should grant to this category of migrant, especially considering their hypervulnerability when compared to adult migrants. Such request, made in the light of the growing migratory flow of unaccompanied minors in the Americas, has led the Court to point to a number of rights that should be particularly guaranteed, such as the right to seek and receive asylum, non-criminalization, non-detention, and non-return of minors, culminating in the desi…

Is a National Court Competent to Introduce a Disclaimer into a Trade Mark Registration? The Latvian Supreme Court Finally Says ‘No’

2021

Abstract It was a longstanding practice of Latvian courts to acknowledge their competence to introduce a disclaimer into a challenged trade mark registration. This had come to be considered as settled court practice. However, the Latvian Supreme Court recently decided to withdraw this practice and explicitly admitted a change of approach concerning the competence of Latvian national courts to introduce a disclaimer into a trade mark registration. In this way, the Latvian Supreme Court finally abolished a disputable practice in the Latvian courts, having formerly allowed themselves to introduce a disclaimer which could – by way of a misunderstanding of trade mark law – be introduced by a cou…

Notes on the Spanish Supreme Court Ruling That Considers Riders to Be Employees

2020

Spain is one of the countries with highest levels of judicialisation of the dispute over the classification of platform working. Dozens of rulings have been issued in recent years. Most have pointed out the labour relation of platform workers in the transport sector, although some have argued that they were truly self-employed. This contradiction in judicial doctrine has allowed / forced the Spanish Supreme Court to rule on the matter. This ruling of 25 September 2020 (rec. 4746/2019) was issued by the plenary session of the Supreme Court on social matters, the decision being adopted unanimously by all the magistrates. The ruling has its origins in the case of a delivery rider who filed an …

Quantitative analysis of the plurality in news programs of Nou at the last stage

2016

© 2020 University of Valencia, Human Rights Institute.
