The Personal Nature of Individual Criminal Responsibility and the ICC Statute

By affirming criminal responsibility of the individual, the ICC Statute recognizes a distinction from the international responsibility of states, which is the basis of modern international criminal law. The importance of the principle is evident not only in the breadth and analytical nature of the provision dealing with it, i.e. Article 25 of the Statute, but by its being placed in the part of the Statute devoted to the ‘General Principles of Criminal Law’. Imprisoned But Innocent: Wrongful Convictions and Imprisonments in Germany, 1990-2016

Although in the United States wrongful convictions and imprisonments are a major public and scientific concern, this topic has been largely ignored in Germany for decades. The present article offers for the first time an overview of all accessible German cases of successful retrials involving convicted persons who served a prison sentence since 1990. The data refer to 31 wrongfully convicted persons in 29 independent cases. Although the largest group consists of cases of false allegations, some of the wrongly convicted were considered not guilty by reason of insanity, and a few wrongful convictions occurred because of eyewitness misidentification and false confessions. Incentives, criminal defence lawyers and plea bargaining

Plea bargaining has become a central feature of criminal procedure in Anglo-Saxon jurisdictions. This paper explores an area seldom discussed in the economic literature on plea bargaining: the influence of the defence lawyer's fee contract on the terms of the bargain. In particular, it uses data from one jurisdiction of the impact on case trajectories of changes in publicly funded defence lawyers’ contracts to test the proposition that the nature of the lawyer's contract influences how cases are managed. The Italian Constitutional Court (141/2019) rejected the issue on the constitutional legitimacy of the crimes of "recruitment" and "aiding and abetting" prostitution, as proposed by the Court of Appeal of Bari. Nevertheless, the causal links between the behavior of facilitating prostitution and the dangers to freedom, security and dignity of the prostitutes are questionable.

AbstractIn prison, the provision of care and the surveillance of inmates takes place in multiple locations with several often contradictory demands. Inmates may experience a fragmentation of services because of the separate silos in which criminal justice service and mental health professionals work and the distinct ways of working that develop within these.
