Principios que rigen la responsabilidad internacional penal por crímenes internacionales

La responsabilidad internacional penal de los individuos se inscribe en el marco de la lucha contra la impunidad de los crímenes más graves y tiene por objeto la persecución y sanción de los criminales que se encuentran a la cabeza de la empresa criminal. Por lo tanto, responde a una serie de principios generales de derecho penal y de derecho internacional que han sido sometidos a una evolución constante por parte de la jurisprudencia internacional. El artículo que se presenta a continuación muestra tal evolución y el estado actual de la discusión en el marco del Estatuto de Roma.

Purpose When making judgements under uncertainty not only lay people but also professional judges often rely on heuristics like a numerical anchor (e.g., a numerical sentencing demand) to generate a numerical response. As the prosecution has the privilege to present its demand first, some scholars have speculated about an anchoring���based unfair disadvantage for the defence (who has the last albeit less effective word in court). A premodern legacy: the "easy" criminalization of homosexual acts between women in the Finnish Penal Code of 1889.

Homosexual acts between women were criminalized in Finland in the 1889 Penal Code which also criminalized men's homosexual acts for the first time explicitly in Finnish legislation. The inclusion of women in the Penal Code took place without much ado. In the article it is argued that the uncomplicated juxtaposing of men and women was due to the legacy of a cultural pattern where man and woman, as categories, were not in an all-pervasive polarity to each other, for example, in sexual subjectivity. In this chapter, Hans Herlof Grelland argues that care is an inherent element in how we can see the world. It is included in our lifeworld perspective. By using Heidegger and Kierkegaard, Grelland thereby shows how sustainability and care can be argued from a philosophical perspective. This provides a thought-provoking introduction to concern or care, setting the scene for a strategy in philosophical terms which highlights the role of education. “Care implies responsibility, and awareness of this responsibility is the beginning of the change which has to come”.
