Available Defences in Provisional measures: Between the Enforcement Directive and National law
2015
AbstractThe EU Enforcement Directive provides a set of provisional measures to be applied upon request from a right-holder of a particular object of intellectual property. Simultaneously, the EU Enforcement Directive envisages a set of defences for an alleged infringer (defendant) in order to safeguard the balance of the parties. This article discusses available defences for an alleged infringer in the provisional measures as provided by the EU Member States when the norms of the EU Enforcement Directive are transposed. Specifically, the present article not only focuses on the threshold of evidence to be presented by a plaintiff for the application of provisional measures, but also in regar…

Groundwater of Sicily (Italy) Close to Landfill Sites: Quality and Human Health Risk Assessment
2021
Groundwater close to three municipal solid waste landfill sites in Sicily (southern Italy) was sampled to determine the presence of contaminants and the risk associated with its possible use as drinking and sanitary water. Polycyclic aromatic hydrocarbons, polychlorinated biphenyls, polychlorinated dibenzo-p-dioxins, polychlorinated dibenzofurans, and metals were investigated. These target compounds are the most common pollutants present in leachates. Risk Assessment Guidance for Superfund (RAGS, US EPA) was used to assess human health risk. Ingestion, dermal, and total exposure to these xenobiotic contaminants in groundwater were evaluated, and the cancer and non-cancer risk indexes were c…
Emission standards versus immission standards for assessing the impact of urban drainage on ephemeral receiving water bodies
2010
In the past, emission standard indicators have been adopted by environmental regulation authorities in order to preserve the quality of a receiving water body. Such indicators are based on the frequency or magnitude of a polluted discharge that may be continuous or intermittent. In order to properly maintain the quality of receiving waters, the Water Framework Directive, following the basic ideas of British Urban Pollution Manual, has been established. The Directive has overtaken the emission-standard concept, substituting it with the stream-standard concept that fixes discharge limits for each polluting substance depending on the self-depurative characteristics of receiving waters. Stream-…

The search for reference conditions for stream vegetation in northern Europe
2008
Summary 1. The European Water Framework Directive provides a framework for improving the ecological quality of stream ecosystems, with deviation from reference used as a measure of ecological status. 2. Here we examine the possibility of using less impacted stream sites from Latvia, Lithuania and Poland to establish a Danish reference network for macrophyte assemblages, and as a guiding image for identification of possible references sites within Denmark. Both approaches were evaluated using historical Danish records. 3. Four different macrophyte assemblages were identified for mid-sized streams in the Central and Eastern Lowland ecoregions. Macrophyte assemblages could not be delineated us…
European response to issues in recycling car plastics
1999
Abstract This paper discusses the issue of recycling of plastics in the automobile industry which has gained importance due to the proposed European Commission regulation on End-of-Life Vehicles (ELVs) where the EC sets targets on the percent recyclablity or reusability of a car by the year 2015. This proposed regulation puts pressure on the car manufacturers to increase the recyclable and/or reusable components of their product. Plastic poses a critical challenge as on one hand it is necessary to meet the customer demands related to esthetics, light weight and the technological advantages, while on the other hand it is a hurdle in achieving a higher percent recyclability of the ELVs. A clo…
A proposal for the analysis of price escalation within water tariffs: The impact of the Water Framework Directive in Spain
2017
During the last few decades, numerous international organizations have emphasized the role of pricing policy as a tool to achieve objectives of efficiency, environmental sustainability, and cost-recovery in the management of water resources. Incorporating a certain level of price escalation within water tariffs by adopting increasing block rates is commonly advocated as a key element for controlling water demand and fulfilling these objectives. However, despite its widespread use, there exists no established procedure to measure the levels of price escalation embodied in water tariffs. We propose a measure of price escalation within water tariffs at the level of the water supply management…
New rules on driver licensing for patients with obstructive sleep apnoea: EU Directive 2014/85/EU.
2016
The widespread recognition that obstructive sleep apnoea (OSA) represents an important risk factor for motor vehicle accidents (MVA), which is reversed by successful therapy with continuous positive airway pressure (CPAP), has led to a revision of annex III of the European Union (EU) directive on driving licences that is subject to mandatory implementation by all member states from December 31, 2015 [1]. This directive was the result of recommendations from a working group established by the Transport and Mobility Directorate of the European Commission in 2012 [2]. The directive states [1] Joint ERS/ESRS working group on the EU directive on issuing driving licences in obstructive sleep apno…
