Attività di impiego e di testing di armi anti-satellite e diritto internazionale

2022

Anti-satellite weapons (ASAT) are one of the major challenges to international security in the «Fourth Domain», namely outer space. This was proved by the test made by Russia in November 2021 and the reaction of the international community. The present testing of said arms against its own satellites, as well as the future and probable operating use of said arms against satellites of other States, raises the problem of their compatibility with international law. In particular, it is being debated in various international fora the legality of ASATs, whose use can generate space debris further congesting terrestrial orbits, thus interfering (and jeopardizing) the activities of other States. Th…

La "due diligence" et le lien entre le sujet et le risque qu'il faut prévenir: quelques observations

2018

The link between a risk to be prevented and a State (or an international organization) is a classical issue of the international law of state responsibility. At variance with the prevailing opinion, it is submitted that the main questions concerning such an issue cannot be answered in a unitary manner. On the contrary, these question need to be framed in the different legal contexts within which they arise. Leaving aside the traditional international legal rules on the treatment of aliens, Ssome observations are developed concerning what occurs in the fields of international human rights, international humanitarian law and international environmental law. La question du lien entre le sujet …

Le organizzazioni internazionali europee fra promozione dei diritti umani e diritto umanitario

2020

This essay aims at critically summarizing the role played by the European Union and the Council of Europe with regard to both the promotion of human rights and humanitarian law following the second world war (para. 2 and 3). The idea is submitted that such a role is currently far from being so active as it was until the end of the '90. A similar conclusion stems from the fact that both the recent case law of the European Court and the recent case law of the Court of Justice (as well as the practice concerning the external relations of the EU in the field of migrations) display a clear tendency not to contribute to the development of the international or the european legal regime of human ri…

Covid 19, Stato di diritto e Convenzione europea dei diritti dell'uomo: il caso ungherese

2021

In this brief intervention it is submitted that the emergency measures against COVID-19, adopted by the Hungarian Government, infringe the rule of law under the European Convention of Human Rights. First of all, these measures appear to be discriminatory, according to art. 1 of the Convention, insofar as they expressly aim at protecting only Hungarian citizens. Furthermore, they are not “necessary” under article 15, given that they extend to the « legal security and the stability of the national economy ». Thirdly, the measures at stake cannot be deemed proportionate (under art. 15), to the extent that : (a) they are not limited in time ; (b) they provide the government with the power to ex…

Formalismo e antiformalismo nell'interpretazione dei trattati nei recenti lavori della Commissione del diritto internazionale

2019

In its Draft Conclusions on subsequent agreements and subsequent practice in relation to the interpretation of treaties the International Law Commission (ILC) has taken a formalistic approach to treaty interpretation, according to which the interpreter should aim at discovering the will of the Parties (and the true meaning of a treaty clause) by using a single combined operation. This means that the interpreter should throw into a crucible all the means of interpretation indicated in Articles 31 and 32 of the 1969 Vienna Convention. The present paper suggests that the depiction of the interpreter as an alchemist who blends different ingredients and gives them the proper weight is a cover th…
