Conciliation is not required prior to arbitration by the President of the Bar in case of a dispute between French lawyers

In two decisions of the First Civil Chamber dated 8 March 2023, the French Cour de cassation indicated that, even though articles 7 and 21 of the Act of 31 December 1971 and article 142 of the Decree of 27 November 1991 referred to conciliation prior to arbitration by the President of the Bar, it was not compulsory. Non-compliance with this requirement cannot therefore be sanctioned by a dismissal.

Sven Johan Östring hoiti Vanhassa Suomessa sijainneen Savonlinnan tuomiokunnan kihlakunnantuomarin virkaa reilun vuosikymmen ajan keväästä 1747 kesään 1760. Kihlakunnantuomarin ja tuomiokunnan rahvaan välit kärjistyivät 1750-luvun lopulla talonpoikien valittaessa toistuvasti tuomari Östringin väärinkäytöksistä. Job protection deregulation in good and bad times

Abstract This paper explores the short-term employment effect of deregulating job protection for regular workers and how it varies with prevailing business cycle conditions. We apply the local projection method to a newly constructed dataset of major regular job protection reforms covering 26 advanced economies over the past four decades. The analysis relies on country-sector-level data, using as identifying assumption the fact that stringent dismissal regulations are more binding in sectors that are characterized by a higher ‘natural’ propensity to make regular adjustments to the workforce. Employment protection : its effects on different skill groups and on the incentive to become skilled

Summary Employment protection affects labour market outcomes and hence the incentive to acquire skills. Using a matching model with two education levels in which workers decide ex-ante on their skill formation, it is shown that employment protection can raise the fraction of skilled workers. This will be the case if workers obtain a sufficiently large fraction of the rent created by skill formation. Furthermore, it will be shown that high-skilled workers face shorter unemployment duration and lower dismissal probabilities.

Globalization of Monitoring Practices: The Case of American Influences on the Dismissal Risk of European CEOs

Accepted version of an article from the Journal of Economics and Business This study examines globalization of monitoring practices by focusing on how American (U.S.) influences on European firms impact the dismissal risk for these firms' CEOs. Specifically, we argue that the stronger short term orientation of the American corporate governance system increase the dismissal performance sensitivity faced by European CEOs, indirectly and directly. The former materializes via European firms cross-listing on U.S. exchanges, the latter results from European firms hiring U.S. independent board members.
