In his lecture notes, the Salamanca scholar Mancio de Corpus Christi († 1576) dealt extensively with the moral-theological question of whether a possessor in doubt as to his entitlement of a possession, lacks the necessary good faith for acquisitive prescription. Mancio discusses, evaluates and compares existing opinions of moral theologians of his time on the matter and expounds on his own teaching. The dialectical discourse reveals that opting for a more or less minimalistic concept of morality is one of the decisive factors.

Abstract Small Island Developing States (SIDS) suffer from several structural characteristics that jeopardize their ability to achieve a sustainable energy future. Their reliance on imported fossil fuels exacerbates their exposure to external threats on international energy markets. Their energy systems are also exposed to internal disturbances that disrupt the proper production, transmission and distribution of energy. A composite indicator of social inclusion for European countries

Social inclusion is one of seven key challenges of the European Union Sustainable Development Strategy. We use a set of sub-indicators to measure social inclusion for 26 member countries of the European Union. In particular, we aggregate four basic indicators in a multiplicative composite indicator via a DEA-BoD approach with weights determined endogenously by imposing proportion constraints. We obtain a score of social inclusion that allows us to grade 26 European countries in 2008, 2009 and 2010 during the European phase of the financial and economic crisis.

The criminal law standard of Beyond A Reasonable Doubt (BARD) constitutes an evidentiary and judicial rule, formulated and applied for centuries in common law jurisdictions, which was expressly stated in the Italian Code of Criminal Procedure only about fifteen years ago. Composite Indicator of Social Inclusion for European Countries

Social inclusion is one of the key challenges of the European Union (EU) Sustainable Development Strategy. We use four indicators from EU policies to measure social inclusion for the 27 member countries of Europe. In particular, we aggregate the four indicators in a multiplicative composite indicator via a DEA-BoD approach with weights determined endogenously with proportion constraints. We obtain a score of social inclu- sion that allows us to grade the 27 EU countries from 2006 to 2010. In this way, we highlight the specific role played by the four indicators in determining improvements and deteriorations of social inclusion during the European phase of the financial and economic crisis.

Ha previsto la possibilità di impugnare una sentenza definitiva di assoluzione per omicidio o crimini internazionali, qualora – in base a nuovi fatti o mezzi di prova – emergano “ragioni stringenti” per una condanna. La riforma ha già sollecitato dubbi di legittimità costituzionale e, per la sua rilevanza, suscita varie riflessioni.

La proposta MiCA, nel regolare il white paper sulle offerte di crypto-assets, sembra tenere in considerazione i benefici e i limiti dei sistemi di voluntary e di mandatory disclosure, non optando integralmente né per il primo, né per il secondo. In quest’ottica, se può condividersi l’approccio regolamentare diretto a graduare, a seconda della tipologia di token offerto, sia il contenuto che l’assoggettamento del documento a mera notifica o ad approvazione ex ante da parte dell’Autorità competente, dubbi sorgono in ordine all’indistinta allocazione dell’onere della prova in capo all’oblato, nei casi di violazione della disciplina del relativo white paper.
