Launch lessons from a growing global supplier of industrial equipment
2008
Although the launch phase in New Product Development (NPD) has been recognised as a vital stage affecting the success of new products, it is often poorly managed for various reasons. The purpose of this paper is to understand launch management in its context better by looking at the drivers and bottlenecks of launches inside a young and growing global industrial equipment supplier with the use of a case study method. The findings of the study show that the enforcement of internal marketing, market knowledge use, marketing communications and the organisation of marketing activities and their links to other company functions are the main drivers of a successful launch. The paper presents a la…

The RedTube copyright infringement affair in Germany: shame on who?
2015
Recently, tens of thousands of German Internet users were confronted with copyright infringement claims for allegedly watching porn clips on the streaming platform RedTube.com. The alleged copyright infringers received ‘Abmahnung’ cease and desist letters that gave them an opportunity to settle copyright infringements out of court by paying rights-holders €250 in compensation. While in cases relating to peer-to-peer file-sharing, the IP address of a peer can easily be identified,1 the RedTube case raises the question how consumers of a stream could be identified. In addition, it raises the question of whether the consumption of a stream is illegal under German law. Assuming that this is not…
Acquiescence to opacity
2017
Opacity may affect both the means used to implement policies and the real objectives that they pursue. Our concern with opacity is limited to the cases when it is the result of obfuscation. that is, of some effort on the part of governments or other public bodies (central banks or international organisations) to hide or misrepresent their choices. In the literature concerned with accounting for inefficient policies, there are now models in which opacity plays no significant role. This chapter provides a number of mechanisms that account for or lead to the phenomenon the authors are interested in, that is, voters preferring a policy to be opaque rather than transparent. It then discusses two…

About the Application in Practice, and Unavoidable Reform, of the Chilean Model of Recognition and Enforcement of Foreign Judgements
2014
The Chilean private international Law has a small and scattered, not quite developed, number of rules. This article focuses on the recognition and enforcement of foreign l…
A survey dataset to evaluate the changes in mobility and transportation due to COVID-19 travel restrictions in Australia, Brazil, China, Ghana, India…
2020
COVID-19 pandemic has heavily impacted the global community. To curb the viral transmission, travel restrictions have been enforced across the world. The dataset documents the mobility disruptions and the modal shifts that have occurred as a consequence of the restrictive measures implemented in ten countries: Australia, Brazil, China, Ghana, India, Iran, Italy, Norway, South Africa and the United States. An online questionnaire was distributed during the period from the 11st to the 31st of May 2020, with a total of 9 394 respondents. The first part of the survey has characterized the frequency of use of all transport modes before and during the enforcement of the restrictions, while the se…
The Authorities’ Attitude Towards Treasure Hunting
2012
Shortly after the fall of the Bastille, a London newspaper was scandalized that people had been imprisoned there for mere trifles. Among the prisoners listed was a certain Girard, allegedly a treasure seeker.1 Was treasure seeking indeed merely a trifling offence? What had the courts and law enforcement agencies of premodern Britain and Europe to say about it? As we have seen in Chapter 1, treasure hunting as such was hardly ever illegal. It was, however, riddled with legal difficulties. What percentage of his find would the treasure hunter actually get? What would the fisc demand for the prince’s coffers? In addition to these juridical problems, an important part of pre-modern treasure hun…
Damages claims for anticompetitive conduct after the Directive 2014/104/EU: Is it (still) worth talking about a private law remedy?
2019
Directive 2014/2014/EU puts the private law remedy of non-contractual liability as the pivot of the entire system of antitrust private enforcement. Neither exhaustive nor containing a “full-harmonization rule,” it promotes the approximation of national laws by introducing a set of substantial and procedural measures, whose main goal is granting the effectiveness of the individual rights to compensation conferred by the antimonopolistic provisions of the TFEU. Many elements, however, induce to wonder about the main features and ultimately the very nature of the remedy by means of which “any person” can claim for damages suffered as a consequence of anticompetitive conduct. The author argues …
L’ILLECITO ANTITRUST DOPO LA DIRETTIVA 2014/104/UE
2020
