Migrants’ economic integration : problematising economic citizenship

2021

Labour market policies to include migrants in their host societies through strategic integration activities usually relate host country belonging to labour market success, commodifying citizenship. Labour market success, however, is not “belonging;” raising the question of whether “economic citizenship” is a misnomer. National citizenships embed territorial, social and ethnic hierarchies in unequal ways. Migrants at the moment of their mobility are outside these national solidarities, and thus are commodified, with their rights depending on their labour market value. Access to national citizenship rights is an important structuring element in segmenting globalizing labour markets. peerRevie…

ASSESSING THE RIGHT TO A “DIGNIFIED LIFE” IN THE CONTEXT OF SOCIAL AND CULTURAL RIGHTS PROTECTION Judicial Success or Failure?

2016

Tis contribution aims at assessing whether or not, and for what reasons, the concept of the “right to a dignifed life” – i.e. the right not to be prevented from having access to minimum living conditions compatible with human dignity – provides an appropriate and effective means to address violations of social and cultural rights within the Inter-American System. Afer presenting the main aspects of the right to live a dignifed existence and contextualising it within the jurisprudence of the Inter-American Court on Human Rights (IACtHR) in the area of economic, social and cultural rights (ESC rights), the analysis focuses on the main strengths and weaknesses that, on both a conceptual and a p…

Climate Change and Global Justice: New Problem, Old Paradigm?

2014

In this paper, we focus on the conceptualization of climate change as an issue of global justice. While we do not deny that climate change raises fundamental and dramatic issues of justice among peoples as well as generations, our claim is that the language of global justice can obscure the fact that problems provoked by climate change lack some characteristic features of problems of global justice, while possessing others that are not characteristic of such problems. We begin by describing briefly how we got to where we are, climatically speaking; we go on to show why it is plausible to think of climate change as provoking problems of global justice; point out four respects in which this d…

Teoría de la educación : revista interuniversitaria

2017

2005

Abuse against elderly persons is extremely frequent, although very often is not declared, and entails high human and financial costs. There are on the whole three types of abuse including domestic, institutional, and auto inflicted. It is difficult to get enough information to define the real dimension of the problem, but data from the National Elder Abuse Incidence Study (NEAIS) describe an increasing and expanding phenomenon. The large proportions of this type of violence has lead the World Health Organization to propose strategies primarily focused on three points: Awareness, Education en Defence. An important role in the prevention and diagnosis of elderly abuse is in the hands of the p…

Convenzione europea dei diritti umani e problemi di costituzionalità della legge elettorale italiana

2013

By an order of 21 March 2013, the Court of Cassation referred to the Constitutional Court the question of constitutionality of the current Italian electoral law on the grounds that it runs counter to the constitutional principles of free and equal suffrage. The Constitutional Court has been called by the referring judge to focus on three main aspects of law: the closed list system; the majority bonus in the Chamber of Deputies, by which the coalition that wins the highest number of votes receives at least 55% of the seats; and the majority bonus in the Senate, which is assigned on a regional level. While the Court of Cassation affirmed that the constitutional principles on the right to vote…

2013

Within the space of less than two years the European Court of Human Rights and the Italian Constitutional Court have returned almost opposing judgments on the question of the observance of political rights by Italy’s 2005 electoral law. The ECHR found the applications made to it by groups of electors inadmissible given the manifestly ill-founded character of the grievances they were based on. The Constitutional Court, on the contrary, concluded that the law was unconstitutional. At first sight, the differing approaches by the two courts and the differing conclusions they reached may be viewed as an expression of the complementary nature of the European system of protection of human rights w…

From the Risk Society to Thana Capitalism

2021

The current paper focused on the spectatularization of disasters as the main commodity thana capitalism exchanges. The discussion around the crimes against mankind perpetrated by Nazis in the clandestine concentration camps opened the doors towards new insights respecting the roots of thana capitalism. Nazis violated human rights secreting their crimes in a moment of the world where millions certainly died. Today´s philosophers are shocked to see how Auschwitz-Birkenau, which was the sanctuary of the horrors of the Second World War, sets the pace to a new allegory, intended to entertain thousands of tourists, many of them unfamiliar with these events. As a highly-demanded tourist destinatio…

The Directive 2014/95/EU – Is there a “New” Beginning for CSR in Romania?

2017

Abstract The global commandments of sustainable development, assumed and translated by the EU into a series of communications and resolutions, have found themselves a new (and more powerful) expression into the “Directive 2014/95/EU (…) as regards disclosure of non-financial and diversity information by certain large undertakings and groups”; in order to increase the transparency of their sustainability-related actions and results, these companies need to report (starting from 2018, by referring to the financial year 2017) information “relating to, as a minimum, environmental, social and employee matters, respect for human rights, anti-corruption and bribery matters”. As regards the Romania…
