Heritage Destruction in Syria and Northern Iraq: Which is the Applicable Law?

The paper aims at reconstructing the applicable legal framework to the widespread destruction of cultural heritage. At first, a legal classification of the conflict under international humanitarian law is provided, with the aim to identify the applicable law. In the second part of the paper, the problem of heritage destruction in Syria is dealt under a double perspective: (i) framing the obligations and potential responsibility fo States (the Syrian Arab Republic and eventually other foreign States involved in the hostilities); and (ii) individual criminal responsibility arising for the perpetrated acts of destruction of cultural heritage.

In this paper we introduce the multidimensional notion of harmonic growth as a situation of diffused well-being associated to an increase of per capita GDP. We say that a country experienced a harmonic growth if during the observed period all the key indicators, proxies of the endogenous and exogenous forces driving population well-being, show a significantly common pattern with the income dynamics. The notion is operationalized via an index of time series harmony which follows the functional data analysis approach. The genetic mechanism of fallness: St. Maximos the Confessor revisited

Through a close reading of the two definitions of evil in the Introduction to Responses to Thalassios , this article points out a circular, cognitive-affective-somatic, genetic mechanism that St. Maximos the Confessor considers responsible for the initiation and transmission of the fallness as a human condition and the specific manifestation of it in the form of passions. It elucidates the first definition as mainly phenomenological, by identifying the circular mechanism and its behavioural expressions, and the second definition as more aetiological, by explaining why this mechanism emerges and reemerges with the fallen humanity despite its catastrophic results.
