The Divorce allowance in Italy, between Rules and Principles

2019

Italian law gives the right to a maintenance allowance to the spouse who does not have ?mezzi adeguati?. The assumption consisting in the ?mancanza di mezzi adeguati?, originally understood by the Joint Sections of the Italian Cassation of 1990 as a lack of resources to maintain the standard of living enjoyed during the marriage, was understood by the Court of Cassation in 2017 as a lack of resources of guaranteeing independence or economic self-sufficiency. In the essay, the author shares this new approach and clarifies that the new interpretation is consistent with the principles and values of the Italian legal system. The author therefore offers arguments to support this new interpretati…

THE TRANSFORMATION OF THE UNDERSTANDING OF JUDGE INDEPENDENCE IN LATVIA

2012

Latvian people’s craving for freedom culminated in the beginning of 1990-s. The activity of the Constitution of the Republic of Latvia was renewed, and the state power was returned to the people. From this moment, the work on dismantling the Soviet legal system in Latvia had started. A legal system had been redirected to the principles of the Western legal branch. The hard core of these principles was already in the Article 1 of the 1920 Constitution of the Republic of Latvia which states that Latvia is an independent and democratic republic. A key element of a democratic state is of a legal state. The division of powers, which is an essential element of a judge's independence, is in force …

Age-related variation in mobility independence among wheelchair users with spinal cord injury: A cross-sectional study

2016

To evaluate age-related variation in mobility independence among community-living wheelchair users with spinal cord injury (SCI).Community Survey (2011-2013) as part of the Swiss Spinal Cord Injury Cohort Study.Community.Individuals aged 16 years or older with traumatic or non-traumatic SCI permanently residing in Switzerland and using a wheelchair for moving around moderate distances (10-100 m).Not applicable.Mobility-related items of the Spinal Cord Independence Measure-Self Report were matched to the three principal domains "changing basic body position," "transferring oneself" and "moving around." Binary outcomes ("independence" vs. "no independence") were created for every domain and a…

Word order and Broca’s region: Evidence for a supra-syntactic perspective

2008

It has often been suggested that the role of Broca's region in sentence comprehension can be explained with reference to general cognitive mechanisms (e.g. working memory, cognitive control). However, the (language-related) basis for such proposals is often restricted to findings on English. Here, we argue that an extension of the database to other languages can shed new light on the types of mechanisms that an adequate account of Broca's region should be equipped to deal with. This becomes most readily apparent in the domain of word order variations, which we examined in German verb-final sentences using event-related fMRI. Our results showed that activation in the pars opercularis--a core…

Long-term sensorimotor and therapeutical effects of a mild regime of prism adaptation in spatial neglect

2015

International audience; Spatial neglect (SN) is commonly associated with poor functional outcome. Adaptation to a rightward optical deviation of vision has been shown to benefit to SN rehabilitation. The neurophysiological foundations and the optimal modalities of prism adaptation (PA) therapy however remain to be validated. This study is aimed at exploring the long-term sensory-motor, cognitive and functional effects produced by weekly PA sessions over a period of four weeks. A double-blind, monocentric randomized and controlled trial (RCT) was carried out. Twenty patients with left SN secondary to stroke were included, 10 in the “prism” group and 10 in the “control” group. The sensory-mot…

Disclosing Conflict of Interest - Do Experience and Reputation Matter?

2009

In a controlled laboratory experiment, we investigate the effects of disclosing conflicts of interest on the reporting of information providers. First, we replicate the findings of Cain, Loewenstein, and Moore (2005) that such disclosure makes misreporting more likely as it removes moral concerns. Second, we observe that these effects diminish given experience and find, to the opposite, that disclosure reduces bias in auditors' reporting as predicted by economic theory. Third, we identify disclosure of conflicts of interest as a potential impediment to reputation formation.

Par Latvijas Universitātes tapšanu 1919. gada septembra preses publikācijās

2022

The author of the article is a 1st year student of the Bachelor's study program at the Faculty of Law of the University of Latvia (UL) and a scholarship holder of the University of Latvia Foundation, whose interests include historical research and public activity within the framework of patriotism. The author has carried out research on the press coverage of the founding of the UL in September 1919, when a decisive event in the history of the Latvian state - the Latvian War of Independence (1918-1920) - took place. The article provides an opportunity to learn new, innovative facts and research directions for future work by other scholarship holders of the UL Foundation or specialists in the…

Probabilities of conditionals and previsions of iterated conditionals

2019

Abstract We analyze selected iterated conditionals in the framework of conditional random quantities. We point out that it is instructive to examine Lewis's triviality result, which shows the conditions a conditional must satisfy for its probability to be the conditional probability. In our approach, however, we avoid triviality because the import-export principle is invalid. We then analyze an example of reasoning under partial knowledge where, given a conditional if A then C as information, the probability of A should intuitively increase. We explain this intuition by making some implicit background information explicit. We consider several (generalized) iterated conditionals, which allow…

Glucose regulation and physical performance among older people: the Helsinki Birth Cohort Study

2018

Aims To assess whether disturbances in glucose regulation are associated with impairment in physical performance during a 10-year follow-up. Methods 475 Men and 603 women from the Helsinki Birth Cohort Study were studied. Glucose regulation was evaluated with a 2-h 75-g oral glucose tolerance test (OGTT) in 2001-2004. Subjects were categorised as having either impaired fasting glucose (IFG), impaired glucose tolerance (IGT), newly diagnosed diabetes or previously known diabetes. Physical performance was assessed approximately 10 years later using the validated senior fitness test (SFT). The relationship between glucose regulation and the overall SFT score was estimated using multiple linear…
