The nineteenth century was characterized, on the one hand, by the common purpose towards the development of legal remedies against the public administration, on the other hand, by different opinions about the best way to achieve this goal. The present paper suggests that the preference for monism was the result of abstract legal ideologies, while the dualist system prevailed on the grounds of effectiveness of legal protection. Today the neo-monism has a different meaning: it is an authoritarian way to make the public authorities free from the narrow constraints of the administrative law.
Free boundary methods and non-scattering phenomena

We study a question arising in inverse scattering theory: given a penetrable obstacle, does there exist an incident wave that does not scatter? We show that every penetrable obstacle with real-analytic boundary admits such an incident wave. At zero frequency, we use quadrature domains to show that there are also obstacles with inward cusps having this property. In the converse direction, under a nonvanishing condition for the incident wave, we show that there is a dichotomy for boundary points of any penetrable obstacle having this property: either the boundary is regular, or the complement of the obstacle has to be very thin near the point. SUMMARY Coping with seasonal changes in temperature is an important factor underlying the ability of insects to survive over the harsh winter conditions in the northern temperate zone, and only a few drosophilids have been able to colonize sub-polar habitats. Information on their winter physiology is needed as it may shed light on the adaptive mechanisms of overwintering when compared with abundant data on the thermal physiology of more southern species, such as Drosophila melanogaster. We consider the recovery of a potential associated with a semi-linear wave equation on Rn+1, n > 1. We show that an unknown potential a(x, t) of the wave equation ???u + aum = 0 can be recovered in a H & ouml;lder stable way from the map u|onnx[0,T] ???-> (11, avu|ac >= x[0,T])L2(oc >= x[0,T]). This data is equivalent to the inner product of the Dirichlet-to-Neumann map with a measurement function ???.
