La scienza giuridica analitica dalla nascita alla crisi

2020

This paper proposes a critical presentation of the analytical approach to legal science. After an introductory paragraph in which a definition of the notions involved (i.e.: «legal science» and «analytical approach») will be offered and some ambiguities affecting the discourses on legal knowldege will be disentangled, the next paragraphs will be devoted to a survey of the main analytical conceptions of legal science. The focus will be in particular on: (1) Alf Ross’s legal realism and his neo-positivistic approach to legal science; (2) Norberto Bobbio and the Italian analytical legal philosophical school, which firmly tie legal science to language analysis; (3) Herbert Hart and the analytic…

Settore L-OR/10 - Storia Dei Paesi IslamiciThis article offers the introduction the Italian translation and the commentary of the Notes on Admissible and Inadmissible Astrological Judgements (Nukat fī mā yaṣiḥḥu wa-mā lā yaṣiḥḥu min aḥkām al-nuǧūm) by Abū Naṣr al-Fārābī (d. 950). It was not transmitted directly by its author and did not reach us in its definitive version but only in the form of notes copied by a grammarian named Abū Isḥāq al-Baġdādī. In thirty short chapters al-Fārābī writes down what is accessible and what is inaccessible to astrological predictions which elements of this science should be accepted and which ones are to be rejected.

Short telomeres drive pessimistic judgement bias in zebrafish.

2021

The role of telomerase reverse transcriptase has been widely investigated in the contexts of ageing and age-related diseases. Interestingly, decreased telomerase activities (and accelerated telomere shortening) have also been reported in patients with emotion-related disorders, opening the possibility for subjective appraisal of stressful stimuli playing a key role in stress-driven telomere shortening. In fact, patients showing a pessimistic judgement bias have shorter telomeres. However, in humans the evidence for this is correlational and the causal directionality between pessimism and telomere shortening has not been established experimentally yet. We have developed and validated a judg…

Il lavoro etero-organizzato prima e dopo il caso Foodora Italia.

2019

This article republishes (after the Italian Supreme Court judgement n.166/2020 on the Foodora Italia case) the contribution to the exegesis of the case brought by art. 1 paragraph 2 of the d. lgs. n. 81 of 2015 (in the text before the 2019 reform) delivered by the author in the 2015's "Colloqui Giuridici sul Lavoro" (edited) by Antonio Vallebona for the "Massimario di Giurisprudenza del Lavoro". The study rejected the thesis that the job organised by the client was an intermediate regulation between the employee and the self-employed ones. Indeed regarding the conditions for its application it showed the need for extensive reading. The conclusion was that the new discipline was (and is) an anti-fraudulent one. It led to a (relative) expansion of the area ofsubordination as a consequence of a reduction in the scope of coordinated self-employed work. A little more than four years after that article the Italian Supreme Court (with the judgement n.166/2020) on the Foodora Italia case addresses for the first time the issue of the hetero-organised work (by art. 1 paragraph 2 of the d. lgs. n. 81 of 2015). The Supreme Court fully adheres to the paper's thesis. So in terms of the "remedial" function of the standardthe nature of the organisation's specific conditionand eventually reducing the legal frame for coordinated work. The fact that the procedural matter dealt with the riders was (then and now is) utterly irrelevant for the correct interpretation of such a new provision. Giving to riders of the employee status is not an effect of the peculiarities of the work through digital platforms. It is a consequence of the remedial nature of such a case-law.

An Internet-based treatment for Flying Phobia using 360° images: Study protocol for a feasibility pilot study

2021

Background Flying Phobia (FP) is a prevalent disorder that can cause serious interference in a person's life. ICBT interventions have already shown their efficacy in several studies, but studies in the field of specific phobias are still scarce. Moreover, few studies have investigated the feasibility of using different types of images in exposure scenarios in ICBTs and no studies have been carried out on the role of sense of presence and reality judgement. The aim of the present study is to explore the feasibility of an ICBT for FP (NO-FEAR Airlines) using two types of images with different levels of immersion (still and navigable images). A secondary aim is to explore the potential effecti…

What's wrong with the adequacy-argument? A pragmatic diagnosis

2011

Published version of an article in the journal: Sophia, 50(1), 11-23. Also available from the publisher at: http://dx.doi.org/10.1007/s11841-009-0153-0 When confronted with the question of which philosophical conception of religion to consider most adequate, many philosophers appeal to what I call the adequacy-argument: that we should prefer the one that looks most adequate from the perspective of religious believers. In this paper, I provide a critique of the adequacy-argument based on a pragmatic analysis of adequacy-judgments according to which reflective adequacy-judgments are forward-looking, and hence include considerations of the consequences of adopting different judgments as guides…

Life Experience, Values and Education

2016

The paper deals with the contemporary problems of education – its functions, mission, humanistic essence and need for the understanding of value. Education is not only school training or getting competences at the highest educational institutions. It is understood as a life experience, where cognition, judgement and practical activity come together in one complex. Nowadays the most popular systems of education are structured on the model based mainly on pragmatism, professionalism, information, technology, to which philosophers are trying to attach moral and cultural dimensions, but their views do not carry much weight. The author agrees with R. Dahrendorf that we need empathetic education …

Dalla svolta linguistica alla svolta interpretativa: ermeneutica giuridica e filosofia giusanalitica a confronto

2020

The interpretative turn that characterized the legal philosophical debate in the last decades offers a privileged viewpoint to observe the dispute between legal analytical philosophy and legal hermeneutics. On one hand it is certainly true that the two traditions of thought have actually been converging for many years; on the other, it is worth noting that legal analytical philosophers are struggling to accept the interpretative turn and, as a consequence, to abandon the neutrality thesis peculiar of methodological legal positivism. Looking at the hermeneutics instead, its next step should be that of rejecting the one right answer thesis, with the awareness that it does not necessarily lead…
