The essay deals with a State aid case between companies belonging to the same corporate group. To clarify the concepts of ‘State resources’ and the misure imputable to the State, the essay suggests framing the concrete case within the framework of the so-called “in-house” company. This does not rule out the application of the private investor test in normal market conditions, which – if disregarded – can overcome the indistinction typical of “in-house” companies.

Since the Spanish Constitution of 1978 there has been a full and effective administrative justice. The citizens have the possibility to request a judicial review of decisions taken by the public Administrations, while being either the owners of a subjective right or of a legitimate interest. The interim judicial protection is not limited to the suppression of the act or general provision and the Courts are invested with direct powers to enforce their sentences. The article discusses the issue of changes of the bases of legitimization for the state judiciary in the US during the so-called “Jacksonian Democracy”, i.e., the period from 1829 (the beginning of the presidency of Andrew Jackson) until the outbreak of the Civil War. During this period on the wave of the democratization process of public institutions in the US, popular elections were introduced to select judges at the state level.
