The European Courts and the Security Council: Between "Dédoublement Fonctionnel" and Balancing of Values

2009

The recent case law of various international tribunals facing questions related to UN Security Council resolutions shows the clear tendency to grant primacy to the UN legal order. This trend, far from being well founded on formal arguments, appears to be a tribute to a legal order perceived as superior, and, at the same time, is revealing of the ‘value oriented’ approach followed by the courts. Such an approach can be categorized from a theoretical perspective in the light of Scelle's theory of relations between legal orders, whereby the courts implement in their respective legal orders values stemming from the UN legal order. Various critical remarks can be advanced in relation to this att…

There are many methods used by drug trafficker…

Constitutional developments in Latin American abortion law.

2016

Abstract For most of the 20th Century, restrictive abortion laws were in place in continental Latin America. In recent years, reforms have caused a liberalizing shift, supported by constitutional decisions of the countries’ high courts. The present article offers an overview of the turn toward more liberal rules and the resolution of abortion disputes by reference to national constitutions. For such purpose, the main legal changes of abortion laws in the last decade are first surveyed. Landmark decisions of the high courts of Argentina, Bolivia, Colombia, and Mexico are then analyzed. It is shown that courts have accepted the need to balance interests and competing rights to ground less res…

Analysis of the Legal and Regulatory Situation of Uncovered Corporate Bond Issuance in the Baltic States: is there a Common Framework Possible?

2021

While the development of the Baltic corporate bond market is based on the uncovered bond segment, the elaboration of the legislative base has a devoted emphasis on the covered bonds. The shift from a country-focused to the pan-Baltic-focused capital market has been publicly acknowledged by the governments (Ministry of Finance of the Republic of Latvia, 2018) and is in line with the ongoing Capital Markets Union initiative of the European Commission (The High Level Forum on the Capital Markets, 2020). Moreover, a pan-Baltic covered bond legal and regulatory framework has been initiated (Ministry of Finance of the Republic of Lithuania, 2019). The strong demand for the corporate bond segment …

Supervision by the state prerogatives of french sports federations

2013

French sports federations have developed without any state intervention. They had their own prerogatives to organize competitions in their respective sporting discipline. By virtue of their association status, they were entirely governed by private law. However, following a decision taken in 1974 by the Board of State confirming the existence of a public service delegated to the federal structure, the legislation gradually devote the principle of granting their prerogatives by the Ministry of Sports through two acts: the ministerial approval and delegation of public service. Since the issuance of these acts is synonymous powers recognized federations by state law and that the delegation lea…

Investigation of sterols as potential biomarkers for the detection of pig (S. s. domesticus) decomposition fluid in soils

2012

This study was carried out to evaluate the potential of using cholesterol and coprostanol, as indicators for the detection of decomposition fluid of buried pigs (S. s. domesticus) in soils. In May 2007, four pig carcasses (~35. kg) were buried in shallow graves (~40. cm depth) at the University of Ontario Institute of Technology in Canada. Two pigs were exhumed after three months (Pig 1, Pig 2) and six months (Pig 3, Pig 4) post burial. Soil samples were collected beneath the pig carcasses (~40. cm depth) and from grave walls (~15-20. cm depth) as well as from a parallel control site. Coprostanol and cholesterol were extracted from soils, purified with solid phase extraction (SPE) and analy…

Sicilians are not easily hooked! first assessment of the impact of recreational fishing on the endemic sicilian pond turtle emys trinacris (Testudine…

2020

The possible impact of recreational fishing on the Sicilian pond turtle Emys trinacris was investigated in two permanent water bodies in western Sicily (Italy). Overall, 120 specimens were temporarily captured and X-rayed in order to determine the possible presence of fishhooks in their mouth, throat, or gastrointestinal tract. At the studied sites, none of the Xrayed turtles showed any evidence of ingested fishhooks or other fishing gears, thus suggesting limited impact of recreational fishing. However, the occasional but not negligible findings of E. trinacris specimens injured by fishhooks or entangled in abandoned fishing lines prove the actual existence of such impact, raising some con…
