Chapter 6 analyses the relationship between International human rights law (IHRL) and international humanitarian law (IHL). IHL represents the new version of a part of the old ius gentium, in particular its ius in bello. Nonetheless, IHL excludes ius ad bellum, formerly linked to ius in bello in ius gentium, in continuity with the Just War Theory. The current IHL is characterized by neutrality, impartiality, and humanity in protecting victims. En este trabajo realizo un análisis jurídico de los elementos constitutivos (tanto subjetivos como objetivos) del crimen de genocidio, tal y como han sido interpretados y aplicados por la jurisprudencia internacional. En concreto, se estudia la jurisprudencia de la Corte Internacional de Justicia, del Tribunal Internacional Penal para la antigua Yugoslavia y del Tribunal Internacional Penal para Ruanda sobre el crimen de genocidio.

Shipmasters are commonly considered the addressees of an international legal duty to rescue at sea. This article describes the evolution of international law in this field, from the first maritime conventions of the 1910's to the IMO Safety Committee's resolutions of the 2010's. It then argues that behind the duty to rescue there is a hidden right of the shipmaster. This right has a moral pedigree and is functional to the full compliance of the duty itself. It can be enforced in the national legal order against any State (or private entity) that tries to obstruct the shipmaster's activities of assistance or to penalize her or him for the assistance given.
