Supervening impossibility of the provision of sports training and coaching due to the 'coronavirus'

The paper analyses the situation of the contracts to provide services that persons or sport organisations agree with their students in the context of expanded health crisis worldwide caused by the coronavirus. Given the diverse background of the readers, reference to specific national or local regulations will be avoided. Instead, general principles of the service contract contained in some studies that have dealt with the transnational harmonisation of private law are considered.

The paper considers two kinds of medieval obligational disputations (positio, rei veritas) and the medieval genre of sophismata in relation to the kinds of inferences accepted in them. The main texts discussed are the anonymous Obligationes parisienses from the early 13th century and Richard Kilvington’s Sophismata from the early 14th century. Il presente contributo analizza la recente riforma in materia di tutela penale dei beni culturali. Lungi però dal voler fornire un quadro generale della stessa, l’articolo si concentra esclusivamente su due profili problematici, entrambi presumibilmente figli di una non adeguata ponderazione delle scelte di incriminazione. Sotto un primo profilo, si analizzano le possibili censure di irragionevolezza sanzionatoria della recente normativa se paragonata alla disciplina prevista dalla legge n. 45/2009.
