‘World Class Local Heroes’: Emerging Competitive Horizons and Transnational Academic Capitalism in Finnish Higher Education – 2010–2012

This chapter introduces an analysis based on institutional profiles of higher education institutions and the two institutional case studies that were carried out in Finland as part of the CINHEKS study. The purposeful selection of the profiles and case studies was based on historical contextualization, the spectrum of higher education institutions in Finland, as well as the twin effects of a major legislative reform, carried out as the global economic crisis of 2008/09 unfolded. This chapter outlines higher education language policies as historically and politically layered and contingent. I will first discuss the way in which I understand language both as a proxy for policies and ideologies and as a means for construing those policies and ideologies. My focus is on the layered and intertwined nature of history, politics, language and nation. The subchapter closes with a methodological discussion of “looking beyond” language—i.e. the ways in which we can take our focus from language to the underlying societal structures. Resumen: La Convención sobre los Derechos de los Niños incorpora los derechos de participación al elenco de derechos e insiste en la realización del derecho a ser escuchado porque consolidan una nueva imagen del niño como sujeto de derecho. Esa escucha del menor de edad en sede judicial, cuando ha cometido un delito, debe permitirle sentirse partícipe del proceso y que el juicio sea percibido como justo y las medidas entendidas como legítimas. Dada la trascendencia de esta escucha, es importante analizar cómo se realiza y qué sentido se le da en la declaración del menor ante la policía o la fiscalía.

The legal relationships with foreign element generate the need to designate the law applicable in the conflict of laws. The national conflictual right and the European regulations govern the two complementary mechanisms for determining the law of the cause. Choosing the law by the parties gives expression to the subjective determination that, for some matters, is the rule, and for others, is the subsidiary solution.
