Normative Legal Positivism, Neutrality, and the Rule of Law

Usually, in jurisprudential debates what is discussed under the rubric of ‘neutrality’ is the claim that jurisprudence is (or at least can, and should be) a conceptual, or descriptive - thus, non-normative, or morally neutral - inquiry. I discuss neutrality in an altogether different sense, namely, neutrality as an ethico-political ideal the law should meet. The issue of lethal autonomous weapons systems (laws) goes to the heart of the debate on new warfare technologies: States, international organizations, non-governmental organizations and civil society at large have long been discussing the acceptability of ‘autonomous killing’. The present contribution zooms in on the position held by the Holy See, exploring its content and the main arguments which support the call of a ban on such technology. L’intento si questo saggio è quello di proporre una ricostruzione critica della concezione dell’autorità legittima di Raz, concezione che sta alla base della sua peculiare versione del positivismo giuridico. Si guarderà dunque alla nozione di “autorità legittima” dall’angolo visuale della filosofia e della teoria del diritto: se la concezione raziana dell’autorità legittima è inadeguata (almeno) in relazione al diritto, allora la versione del positivismo giuridico difesa da Raz mancherà di un’adeguata giustificazione.

The article presents the issue of trust in law as one of the fundamental values of a rule-of-law state. The analysis of the court rulings conducted in the first part of the article indicates the principle of a democratic rule-of-law state as a basis for distinguishing substantive and formal components of trust in law. Some serious limits of Hart’s practice theory of norms concern the conception of legal obligation and normativity of law. La crítica de Adorno al positivismo

Esta investigación tiene por objeto las reflexiones epistemológicas Adorno. El objetivo pasa por analizar la singularidad de su sociología dialéctica puesta en movimiento a partir de la crítica al positivismo. De acuerdo con este objetivo, se desarrolla un plan de lectura de Adorno guiado por la pregunta althusseriana por la construcción de la problemática. La tesis que sostenemos es que la diferencia esencial entre el positivismo y la sociología dialéctico-negativa de Adorno reside en que, mientras que el positivismo sitúa el problema del conocimiento en el terreno epistemológico, Adorno lo hace en el práctico, y esto tiene efectos políticos.
