Resisting Immigration Detention

2016

The aim of this article is to provide a normative analysis of the ways in which immigrants resist immigration detention. After having outlined (in Section 2) some general features that make immigration detention a rather abnormal condition for human beings to be kept in, I distinguish three main forms of resistance to it: institutionalized, non-institutionalized, and anti-institutional. I first spell out, in Section 3, some individual characteristics of these forms of resistance. Then (in Sections 4 and 5), using Italy as my test case, I suggest, for each of these forms, an interpretation of their normative meaning (that is, their meaning according to both the relevant legal rules and their…

Custody and Care of Children in Spain: can the Two Rights be Reconciled?

2021

AbstractThis study aims to analyse the legal decision-making process in the Community of Valencia (Spain) regarding contentious divorces particularly with respect to parental authority (patria potestas), custody and visiting arrangements for children, and the opinions of mothers and fathers on the impact these judicial measures have had on their lives. It also considers the biases in these decisions produced by privileging the rights of the adults over those of the children. Three particular moments are studied: (1) the situation before the break-up, focusing on the invisible gender gap in care; (2) the judicial process, where we observe the impact of hidden gender-based violence and gender…

Human traffickers frequently take advantage of operative protocols that make them unpunishable pursuant the Italian Criminal Law because according to Art. 6 of the Italian Penal Code and International Convention on the High Sea jurisdictional powers cannot be exercised when the conduct is committed on the High Sea. So illustrating the territorial limitations of the efficacy of Criminal Law the research focuses on the hermeneutical solution given by the Court of Cassation that apparently with the intent of pursuing a more effectivity of the Criminal response recurred to the controversial category of the indirect offender in order to sanction smuggling conducts that enjoy the rescue intervention of the Italian authorities to reach their criminal aims. In turn in order to better identify the Italian jurisdiction in the crime of Art. 12 T.U. imm. I propose to correctly apply the concorso di persone (art. 110 c.p.) and the reato eventualmente permanente. The difficulties of a dogmatic framing together with the trend towards a universalistic validity of the jurisdictional powers when human rights are involved may recommend an interpretation of Art. 7 of the Italian Penal Code to cover a wider protection of human rights according to interpretive solutions of § 6 of the German Penal Code.Settore IUS/17 - Diritto Penale

Program for the Prevention of Violence among Teenage Couples in the School Setting

2015

Domestic violence remains one of the major problems in the 21st century entailing severe costs and consequences for the victims. Despite the promulgated laws, this type of violence has increased among adolescents. Although several theories have been put forward to explain the causes of domestic violence, a psychobiological or social-educative explanation that proposes an agreed starting point for understanding and preventing this phenomenon is lacking. Experts in the field agree on the need for programs that focus on this relational problem; however, existing programs for adolescents have a broad spectrum where the prevention of domestic violence is just one more aspect of their objectives.…

Discrimination in the sharing economy: evidence from a hungarian field experiment on the topic of ridesharing

2018

This paper describes small-scale experimental research (total N=160) implemented in Hungary in summer 2017 by TÁRKI, the Hungarian Social Research Centre. The research was based on a controlled field experimental design and examined the chances of ethnically different testers being offered rides on the most well-known international ridesharing platform. The creation of eight experimental profiles enabled us to test the interaction between two experimental stimuli: ethnic/racial background and gender. The present paper provides evidence of ethnic/racial disproportionality in offers of rides to the different testers by multiethnic drivers. A large-size effect was detected in the case of the A…

Frailty Tools for Assessment of Long-term Prognosis After Acute Coronary Syndrome

2020

Objective: To evaluate the 5 components of the Fried frailty phenotype (self-reported unintentional weight loss, physical activity questionnaire, gait speed, grip strength, and self-reported exhaustion) for long-term outcomes in elderly survivors of acute coronary syndrome. Methods: A total of 342 consecutive patients (from October 1, 2010, to February 1, 2012) were included. The 5 components of the Fried score and albumin concentration, as malnutrition index, were assessed before hospital discharge. Patients were followed up until April 2020 (median follow-up, 8.7 years). The end point was postdischarge all-cause mortality. Results: Mean ± SD age was 77±7 years and mean ± SD Fried score wa…

Choosing Who You Are: The Structure and Behavioral Effects of Revealed Identification Preferences

2017

Differences in individuals’ social identity have recently been shown to explain differences in behavior. But where do differences in social identity come from? Theory claims that identification allows people to affect their social identity by choosing who they are. Accordingly, this paper treats social identity as a choice and analyzes its behavioral effects. We find identification to be systematically related to behavioral heterogeneity in group-specific social preferences. In a first step, we measure identification preferences using a revealed preference approach in a laboratory experiment. Confirming social identity theory, participants reveal a stronger identification preference for gro…
