Competence Aspects of Responsible State Institutions

2014

One of the specific features of the law on IGOs relates to the fact that competence of state institutions of EU Member States for prosecution of the infringements of IGOs is envisaged within their jurisdictions. Therefore, in the case of IGOs, their infringements will be prosecuted both by right-holders of IGOs and state institutions of EU Member States. Considering these both prosecution possibilities, right-holders of IGOs have a choice either to prosecute infringements of IGOs themselves, i.e. bringing a case to a court if out-of-court settlement procedures were not successful or were not even chosen, or to apply to a state institution having competence to prosecute infringements of IGOs…

Structural performances of pultruded GFRP emergency structures – Part 2: Full-scale experimental testing

2019

Abstract This paper presents an experimental testing of a pultruded glass fiber reinforced polymer (FRP) structure used for emergency applications continuing the discussion presented in a previous paper (part 1) where the study of the characteristics of material and elements are presented. First, the design of the composite structure and components and the evaluation of the structural behavior by means of numerical and analytical approach according to current regulatory codes are described. In this frame, the global and local response was observed according to load paths deriving from the design loads at limit states. Then, the experimental test on a full-scale 2D model is presented at diff…

Differences in Immaterial Details: Dimensional Conversion and Its Implications for Protecting Digital Designs Under EU Design Law

2021

AbstractThe paper considers three main questions: the legal status of digital designs from the perspective of EU design law, whether the protection is tied to the reproduction of physical products, and whether the scope of protection covers dimensional conversion such as using a 3D design in 2D form or vice versa. There are two sets of views regarding dimensional conversion: the “abstract” and the “concrete” view. These two different attitudes towards the scope of protection influence the manner in which the protectability of digital designs is assessed. In the “abstract” protection, it would not matter whether a product only exists as a digital image and not as a physical shape. In the “co…

A legal and economic analysis of the concept of anticipatory breach under the CISG

2021

Contractual remedies are traditionally available after the breach of a contract, but can a party suspecting non-performance prior to the date of performance entitled to seek for remedies? The United Nations Convention on the International Sale of Goods (CISG), regulates the doctrine of anticipatory breach in Articles 71-73, outlining the circumstances in which an anticipatory breach is deemed to occur and the remedies available to the aggrieved party. The Convention entitles the innocent party to the right to suspend or avoid but it contains unambiguous terms in need for interpretation. Additionally, the doctrine of anticipatory breach begs the questions of economic efficiency, a fundamenta…

Impact of European Data Protection Reform on direct marketing

2019

This study explored the influence of the legislation adopted under the EU Data Protection Reform on the direct marketing. Since the introduction of the previous data protection legislation, the amount of data collected, processed and stored has grown exponentially, resulting in the increased risk to the data security of an individual. Thereby, introduction of new rules is a necessity in order to achieve proper execution of data subject’s rights in the digital age and create efficient and simplified rules for the companies to apply. Direct marketing is based on the actions connected to personal information – data is gathered via cookies, stored for the purposes of communication and analyzed …

Observing the anisotropic optical response of the heavy-fermion compound UNi2 Al3

2010

The optical conductivity of heavy fermions can reveal fundamental properties of the charge carrier dynamics in these strongly correlated electron systems. Here we extend the conventional techniques of infrared optics on heavy fermions by measuring the transmission and phase shift of THz radiation that passes through a thin film of UNi 2 Al 3 , a material with hexagonal crystal structure. We deduce the optical conductivity in a previously not accessible frequency range, and furthermore we resolve the anisotropy of the optical response (parallel and perpendicular to the hexagonal planes). At frequencies around 7 cm -1 , we find a strongly temperature-dependent and anisotropic optical conducti…

2022

Veidojot saistītu runu, jāņem vērā, ka bieži vien vairāk tiek uzsvērts konkrētās runas konteksts, nevis pareizas gramatikas un izrunas īpatnības. Šādās runās var novērot daudzas saistītās runas īpatnības atkarībā no runātāja emocionalitātes, attieksmes pret konkrētās runas ideju, valodas variācijām, runas tempa, intonācijas utt. Šajā pētījumā galvenā uzmanība pievērsta runas iezīmei elīzija, kas rodas, ja saistītās runas veidošanas laikā tiek izlaista kāda skaņa. Šī pētījuma mērķis ir izpētīt saistītās runas pazīmes - elīzijas īpatnības, vēsturiskos un mūsdienu aspektus un analizēt šīs pazīmes sastopamības variācijas Lielbritānijas un Kanādas premjerministru runās, ņemot vērā runas formalit…
