Secondo questa prospettiva, il diritto è il discorso del legislatore e la scienza giuridica non è altro che un discorso sopra un discorso: un meta-linguaggio descrittivo del linguaggio prescrittivo del legislatore. The article examines Celano's conception of the Rule of Law in order to underline its limits. It identifies the main reason for its limits in the use of the methodology of analytical jurisprudence, that is not able to look at the law as it is: a differentiated phenomenon. The article proposes to look at contemporary law and to rethink the idea of the rule of law accordingly.

In a section of the De officiis, Book i, Cicero deals with the justice of warfare. He asserts that the enemies defeated who were not cruel and savage should be spared, so the maiores utterly destroyed Carthage and Numantia (i 35). In i 38 Cicero refers to the wars undertaken by Romans, distinguishing the ones waged de imperio (as the Punic wars) from the others fighted uter esset (as the wars against Celtiberi and Cimbri): the first must be fought less cruelly, but Cicero justifies the destruction of Carthage with the sentence Poeni foedifragi, crudelis Hannibal, reliqui iustiores, probably containing a quotation from Ennius’s Annales. We observe insult as a linguistic form (Dérive and Dérive 2004; Laforest and Vincent 2004; Lagorgette and Larrivée 2004) within a deliberately heterogeneous, chronologically and genre-wise, corpus of comics and GR. Do we need earth jurisprudence? Looking for change in new old friends

The article introduces the reader to the theory of Earth Jurisprudence through an analysis of the writings of Thomas Berry, Cormac Cullinan and Peter Burdon. After looking at the main revisions that the scholars of Earth Jurisprudence propose to the theory of law, the article recognizes the fact that they all move in the direction of natural law theories and questions the opportunity to take this path in order to change the relationship between human law and the environment.
