Supervisory Review Process

This chapter addresses the legal outlining of the supervisory review process. There is an apparent contradiction between principles-based insurance supervision on the one hand and, on the other hand, legal certainty along with foreseeability of supervisory action under art. 36 of the Solvency II Directive. With this in view, the chapter next examines the objectives and subject matter of the supervisory review process, with particular scrutiny given to requirements relating to solvency and governance. The powers of supervisory authorities to remedy weaknesses and deficiencies are then taken up.

The text attempts to conceptualize the possible reform of the procedure of making notarial deeds in Poland. It examines the feasibility of drafting and signing these deeds in the course of online communication between parties. The analysis builds on the significant constraints for the classic notarial procedure (based on paper documents and on the physical presence of a notary and parties) that were triggered by the Covid-19 pandemic. Its aim reaches, however, further beyond the present-day realities and seeks possible ways to generally modernize provisions on notarial deeds and to adjust them to the growing proliferation of online communication in the society. This article examines whether Locke can consistently maintain that perception is a fully passive process. His view is put under scrutiny under two senses of activity. Does Locke reject active perception in light of his own understanding of activity; or rather, does he treat perception as passive in that the mind has only a general capacity of reception of ideas and does not contribute in specific ways to organizing specific types of perceptions? Just transition is gaining increasing attention. The need to consider social justice in sustainability transitions is finally being acknowledged. Research on this issue has, to date, mainly concentrated on energy systems. In this paper, we examine how the elaboration of dietary transition widens the spectrum of justice questions in sustainability transitions research. We explicate the arising normative questions along the dimensions of distributive, procedural and recognitive justice; widening the considerations further to restorative and cosmopolitan justice.
