Perpetuating Anti-Muslim Discrimination through the Interpretation of Religious Equality in the European Court of Human Rights

AbstractFaced with widespread prejudice and discrimination, European Muslims are increasingly resorting to the European Court of Human Rights as a last-ditch strategy to transform state policies toward minority faiths. While the Court has a mandate to protect religious freedom and equality, the conservative and sometimes biased way in which it has interpreted these concepts has enabled the persistence of stark asymmetries in the legal and social statuses of different religions. Using an analysis of relevant cases, this article seeks to highlight the judicial processes that currently sustain Muslim subordination and pinpoint specific reforms that could reverse the trend.

The increasingly acknowledged post-secular perspective has resulted in the emergence of some new approaches theorizing this phenomenon. One such approach has been the concept of religious engagement, which calls for the redefinition of the perception of religious non-state actors towards including them as important partners in the process of identifying and realizing political goals. What should be the right place for religions in France ? Our debates are old and sharp. France has two legislations : a concordat (Napoléon) for two departments and the common rule (1905). The word "Laîcité" was not employed at the beginning, but appears progressively. Do Muslims living in France are changing the concept ? Do they imply a new manner of seeing things ? What are the results of the attacks of 2015 and 2016 on the opinion ? We analyse in this communication for the universities of Bucharest and Craiova articles published in the newspaper Le Monde. Building on research highlighting the complex webs of relations between secularism, culture, and religion, this study investigates how the concept of culture was utilized in discourses of laïcité from the newspaper le Monde. Articles (N = 76) published between 2011 and 2014 were analyzed using qualitative content analysis. Results revealed the agency associated with the use of culture as it was strategically – rather than systematically – used in opposition to religion. Overall, culture – and the practices it defined – tended to be represented as normal and invisible.
