Local Leadership and Its Limits in the Deployment of Sustainable Mobility Policies
2020
The indisputable need for new urban mobility policies, which has already been recognised in numerous international, European and national legal instruments, undoubtedly requires a local role in the redefinition of these policies. This action must be carried out in a regulatory context that does not always provide local authorities with all the legal instruments to do so. In this contribution, the primary measures being used to achieve greater sustainability of urban mobility are outlined, as well as a description of the effective room for manoeuvre local authorities normally have, analysing the current limitations they face for a more ambitious deployment and possible models of alternative …

Thus, these companies develop their core business completely through workers classified as self-employed. In this context, employment law is facing its greatest challenge, dealing with a very different reality compared to the one existing when it was created. This pa…

Sharing Economy: A Business Perspective
2020
The developments in information technology on the one hand, and the reduced purchasing power of many people due to the global crisis as well as the increasing sustainability concerns on the other hand, have contributed in recent years to the creation of a multitude of Internet-enabled peer-to-peer platforms and the consequent rise of a new paradigm of economy, namely the sharing economy. Under this paradigm, consumers on a massive scale share and make use of underutilized resources upon payment. The so-called collaborative or sharing economy constitutes a multifaceted concept of increasing relevance and evolving in definition that will constitute the focus of our study. This article is presented methodologically as a macro-synthesis of the main trends of the economy, from its local and global spheres, in the convergence that can be glimpsed from the new phenomenon that we are dealing with of neo-capitalism based essentially on digital platforms and media. Some have already advanced it as turbo-capitalism or capitalism 3.0, in increasing expansion from the analysis of massive data from digital platforms. The resulting greater efficiency of decentralization and heterogeneity can be e…

The public sector's roles in the sharing economy and the implications for public values
2019
Abstract Motivated by the growing significance of the sharing economy, we discuss the roles the public sector may play within the sharing economy and the corresponding implications for public values. The sharing economy represents a transformative agent for the public sector within the current landscape of digital transformation. While the public sector has so far acted mainly as a regulatory body in the sharing economy, we here discuss implications for other roles the public sector may take on, including the roles of customer, service provider, and platform provider. Framed within the context of the public value ideals (professional, efficiency, service, and engagement), we examine the opp…
Consolidated challenge to social demand for resilient platforms : Lessons from Uber's global expansion
2017
Many in the industry see the ride-sharing company Uber as the significant advancement through information and communication technology (ICT) particularly of the digital service platform and sharing economy. Uber has been exploring the new frontier of the ICT-driven disruptive business model (IDBM) and succeeded in its global expansion to over 479 cities in more than 75 countries worldwide in June of 2016. Such rapid expansion provides constructive insights regarding the significance of IDBM, not only in transportation but also in almost all other business fields. While at the same time Uber's legal battles in some cities around the world raise a serious question regarding the rationale of I…
Regulating and Deregulating Sharing Mobility in Europe
2020
This chapter gives an account of the many legal issues related to the rise of sharing mobility in Europe, as part of the activities carried out within the 2018–2020 Jean Monnet Project “Regulating and Deregulating Sharing Mobility in Europe” (RIDER). In the first part, it outlines the most fundamental economic transformations that make the case for regulating sharing mobility services quite different from conventional transport. By also referring to the activities carried out during the project, it identifies those emerging legal issues stemming from the advent of sharing mobility, in order to categorize the competing claims that regulators should be considering when facing these innovative…
