Basque nationalism within the constitutional framework of the Second Spanish Republic (1931-1936)
2019
The cultural mission of universities
2017
Over the last two decades, there has been a wide debate about the so‑called third mission of the University. Two discourses have occupied the proscenium: the transfer and innovation of knowledge and corporate social responsibility. In this article we postulate that both these ideas respond to approaches that do not fully take the history and status of universities as a public service into account. In contrast, we argue that the third mission, both in terms of history and in terms of the normative and pragmatic statutes, instead corresponds to culture.
Special Civil Law as a Sign of Political Identity: A Constitutional Approach to the Case of the Valencian Community
2013
We seek to clarify the political terminology and meaning of what is contained in the Valencian Statute in the light of the (far more developed and diverse) doctrinal and jurisprudential contributions to arise from the demands of other autonomous communities. This is necessary after the 2006 reform of the Valencian Statute, due to the tendency towards historical law evident therein, and is also essential if progress is to be made towards the constitutional reform that will bring to a close the evolution of the Autonomous State into an ordered Federal State.
W cieniu trudnej przeszłości — kolejna odsłona kryzysu katalońskiego
2021
The purpose of this article is to present the repression that hit Catalonia during the Spanish Civil War (abolition of autonomy and return to centralism, criminal sentences of a political nature), thus showing that prudent political choices, dialogue, and mediation in Catalonia are a matter of utmost importance. Historical experiences should not become an element of political games but motivate a debate between the central government and the autonomous region on reforming the state system and improving cooperation mechanisms. For Catalonia, the dictatorship meant cancelling all republican legislation and judicial decisions and the annulment as well as annulling the Catalan autonomy statute …

Workers, the self-employed and TRADEs: Conceptualisation and collective rights in Spain
2019
The subjective scope of application of Labour Law is set by the Statute of Labour. Nevertheless, the interpretation of the Courts is crucial to understand who is a worker in Spain. In this study, the criteria set by the Spanish courts and their evolution are analysed. Recently, the Spanish Supreme Court seems to have abandoned the ‘control test’ criteria for classifying workers and has moved towards a personal conceptualisation of work. This paper shows rulings that prove this evolution. Moreover, Spain has its own Self-employed Workers’ Statute applicable to common self-employed workers and economically dependent self-employees (TRADEs). In this paper I analyse the concept of both types a…
Undeclared work and legal instruments for combating it in Spain
2018
Abstract: This article analyses the measures adopted in Spain to combat undeclared work, although only with respect to activities included in the scope of the Spanish Workers’ Statute (workers under employment agreements). For the purposes of this analysis, the measures have been broken down into three main groups: control measures; measures to combat illegal employment and, finally, measures to promote legal employment. The paper concludes with some reflections on the effectiveness of these measures. Keywords: Undeclared work. Control instruments. Promotion of declared work. Sanctions against undeclared work. Spain.

1999
Although this title might be somewhat provocative, there is no intent to be anti-schoelcherist. The aim is not to diminish Victor Schoelcher's considerable achievements, but to fight against the unanimous preconceptions that have transformed this man into a myth. By studying the legal and political consequences of his proposals and his engagements, we have underlined not only the extent and complexity of his work for the Republic - that has been little known up to now, though Schoelcher ought to be considered to be one of the fathers of the Republic - but his contradictions too. Schoelcher was so sure of the virtues of the republican values of the mother country, that his fight, albeit huma…
