L’accertamento del trasferimento d’azienda in caso di cambio di appalto nel rito “Fornero”

Con la sentenza n. 2315/2020 la Suprema Corte ha affermato il principio che l’accertamento dell’anzianità di servizio conseguente ad un trasferimento d’azienda può essere affrontato nell’ambito del rito speciale di impugnazione del licenziamento introdotto dalla L. n. 92/2012. Nella decisione in commento la Corte ha altresì modo di dare continuità all’orientamento per cui la fattispecie traslativa si perfeziona anche in presenza di un mero passaggio di personale in forza di obbligo contrattuale o di legge. With judgement n. 2315/2020 the Supreme Court affirmed the principle that the ascertaining of seniority of service of the employee because of a transfer of undertaking can be examined by the judge according to the special rules of law n. 92/2012. The Court does not exclude a transfer of undertaking also in the case it concerns the staff only for a contractual or legal obligation. The institution of the Real Audiencia in the kingdom of Sardinia since the 1560s is part of a wider process which saw the rise and development of royal supreme courts of justice in several European countries of the early modern period. In fact, major State formation processes all around Europe required that monarchs increased their control on local authorities and that new increasingly centralised systems of judicial review gained precedence over all particular jurisdictions, feudal as well as municipal. Przedmiotem opracowania jest charakter prawny uchwał Sądu Najwyższego. Charakter ten jest sporny w doktrynie. W tym zakresie występują trzy odmienne stanowiska. Według jednego z nich „uchwały Sądu Najwyższego są orzeczeniami”. Drugie stanowisko przyjmuje, iż „uchwały Sądu Najwyższego stanowią odrębną grupę orzeczeń, nie są jednak orzeczeniami sądu, które dotyczą przedmiotu procesu, ponieważ nie rozstrzygają wprost o jego przedmiocie”. Trzeci kierunek głosi, że „uchwały Sądu Najwyższego, wydawane na podstawie art. 441 § 1 k.p.k., rozstrzygające zagadnienia prawne, nie należą do kategorii orzeczeń”.
