This Article analyses the effects of succession of States in respect of international treaties on human rights. This is a matter not codified by the Vienna Convention on Succession of States in respect of Treaties. We have to bear in mind that human rights treaties have been adopted by international organisations, which have developed their own practice both for the succession of States as States Members of an international organisation and for the succession of States as Contracting Parties to treaties that the United Nations, the Council of Europe or the European Union have adopted in the field of human rights.

Amending UN drug treaties to allow member states self-determination

Purpose – This paper aims to analyse the fundamental principles of the main international conventions against use of drug and to verify if it would be preferable to let European Member States adopt specific measures according to own needs at a national level. Design/methodology/approach – The research uses a comparative approach by examining the different national legislations in respect of the discipline of the international conventions for finding analogies and differences between them. The concept of ‘direct applicability’ and ‘self-executing’ nature of international norms is still object of intense debate in the international legal scholarship. In Italy, such a debate has attracted new attention in the light of a recent ruling of the Joint Sections of the Court of Cassation, according to which the norms enshrined in the European Convention of Human Rights are not directly applicable in domestic proceedings.
