El autor analiza el tratamiento normativo de la cláusula penal en el Derecho civil español, con especial atención a la regulación que ofrece el Código Civil en sus arts. 1152 a 1155, las diferentes funciones que asume la cláusula penal y la distinta regulación presente en el Fuero Nuevo de Navarra en su Ley 518.
