Zasada specjalności europejskiego nakazu aresztowania i art. 607e § 3 pkt 2 k.p.k. a możliwość ścigania wydanego obywatela polskiego za przestępstwa …
2022
The article addresses the so-called principle of speciality referred to in Article 607e of the Criminal Procedures Code in connection with Article 27 of the Council Framework Decision of 13 June 2002 no. 2002/584/JHA on the European arrest warrant and the surrender procedures between Member States, and the exception to that rule specified in Article 607e § 3, item 2 CPC and Article 27(3)(a) of the EAW Decision. This article also assesses the order of the Appellate Court in Gdańsk of 31 May 2016, case reference II AKzw 921/16, and the argument that the deadline of 45 days referred to in Article 607e § 3, item 2 CPC cannot start to run with respect to a Polish national. The article refers to …
Sequential Warrant Exercise in Large Trader Economies
2007
It is well known that the sequential (premature) exercise of American-type warrants "may" be advantageous for large warrantholders, even in the absence of regular dividends, because using exercise proceeds to expand the firm's scale increases the riskiness of an equity share. We present sufficient conditions for the non-optimality of sequential exercise implying that for realistic interest rate levels even large warrantholders are better off not to exercise long before maturity. This result, however, does not justify in general the simplifying restriction that warrants or convertible securities are valued as if exercised as a block.
Stochastic Fatigue Models for Efficient Planning Inspections in Service of Aircraft Structures
2008
For important fatigue-sensitive structures of aircraft whose breakdowns cause serious accidents, it is required to keep their reliability extremely high. In this paper, we discuss inspection strategies for such important structures against fatigue failure. The focus is on the case when there are fatiguecracks unexpectedly detected in a fleet of aircraft within a warranty period (prior to the first inspection). The paper examines this case and proposes stochastic models for prediction of fatigue-crack growth to determine appropriate inspections intervals. We also do not assume known parameters of the underlying distributions, and the estimation of that is incorporated into the analysis and d…
The Protection of the Right of Freedom on the European Union Level: The European Arrest Warrant and Non-custodial Pre Trial Measures. The Guideline o…
2012
“Protection of fundamental rights in particular must be central to the operation of the system:” this formula, found at the heart of the most recent official assessment of the EAW (2011), perfectly summarizes, in terms of political policy, the progressive shift of emphasis from efficiency and security towards the primacy of the protection of individual rights across the entire field of EU measures restricting individual liberty. The experience gained in terms of the principle of proportionality thus becomes a basic paradigm for the interpretation of the system in terms of applied law. The three levels through which the filter of proportionality has operated in the system of the EAW (multile…

2013
The Constitution of Latvia – A Bridge Between Traditions and Modernity
2019
The Latvian constitutional system is based on the principle of State continuity after the Soviet occupation, and this is reflected in the reinstatement of the 1922 Constitution (Satversme). Unlike other constitutions in the post-communist area, it is characterised as a laconic and predominantly procedural constitution. However, important amendments were introduced in 1996 and 1998, establishing the Constitutional Court and introducing a catalogue of fundamental rights. The constitutional culture has been influenced by German traditions in constitutional jurisprudence, and the adjudication of legislation on substantive grounds has been stringent. This is particularly evident in the annulment…
Contact with Nature as Essential to the Human Experience
2021
Human contact with nature is more important than ever before considering the global confinement brought about by the COVID-19 pandemic, the increased urbanization of society, and increased rates of mental disorders and threats to human well-being. This article conveys the importance of contact with nature from three perspectives: historical, sociocultural, and scientific. These perspectives convey the many ways in which contact with nature is essential to human life, the multiple ways in which this is expressed, and the broad range of benefits this has. The case for preserving the natural environment continues to be made in light of the dangers of climate change, the deleterious effects of …
Unbiased Simultaneous Prediction Limits on Observations in Future Samples
2013
This paper provides procedures for constructing unbiased simultaneous prediction limits on the observations or functions of observations of all of k future samples using the results of a previous sample from the same underlying distribution belonging to invariant family. The results have direct application in reliability theory, where the time until the first failure in a group of several items in service provides a measure of assurance regarding the operation of the items. The simultaneous prediction limits are required as specifications on future life for components, as warranty limits for the future performance of a specified number of systems with standby units, and in various other app…
A Reduced-Form Model for Warrant Valuation
2011
This paper studies warrant valuation using a reduced-form model. Analogous to the credit risk literature, structural models require complete information about the asset value process and the firm’s liabilities. In contrast, reduced-form models require only information about the firm’s stock price process. We introduce a reduced-form model where the warrant holder is a price taker, and we relate our model to structural models appearing in the literature.
