Reflections about the authentic document in "post mortem" fecundation

[EN] The legislation on assisted reproduction contemplates the ¿post mortem¿ fecundation. Nevertheless, the document for the presentation of the assent raises some doubts in relation with the principle of party autonomy and the new technologies of the information and communication (ICTs). In the present work one thinks about these questions and one tries to contribute some solution of application in the Spanish legal system.

During the Late Holocene, hunter-gatherer interaction networks significantly grew in intensity and extension across Patagonia. Although this growth is evidenced by the increased flow of exotic items across the region, the mechanisms behind these strengthening social networks remain unclear. Since evidence suggests that some individuals might have performed long-distance trips, this article aims to address the potential relationship between these individuals and the flows of exotic items in North Patagonia. El govern espanyol prioritza la que denominen «lluita contra la migracio irregular» front al compliment dels compromisos que com a Estat, ha signat en materia de Drets Humans, vulnerant aixi el dret al asil i a la Proteccio Internacional recollit, entre d’altres, en la Convencio de Ginebra sobre l’estatut de les persones refugiades.

Dopo avere passato in rassegna la contumacia, il contributo analizza nelle grandi linee il contenuto della l. n. 67/2014 che ha soppresso il suddetto istituto, sostituendo il processo in contumacia con il rito in assenza dell'imputato e con la sospensione del processo nei confronti dell'irreperibile, modulando diversamente l'itinerario e i congegni restitutori in base a tre distinte situazioni di mancata comparizione. Infine, segue una breve sottolineatura dei profili critici, nella consapevolezza della parzialità dell'analisi per l'assenza di un confronto della disciplina col "diritto vivente".
