Succession of states in respect of state responsibility: towards yet another Vienna Convention?

The present work analyses the historical evolution of the rules on succession of states as well as provides a review of case law where the Court referred to the concept of state succession to international responsibility, expressly or by implication. The author analyses the wording of the proposed Draft Articles and attempts to establish whether and how the principles of automatic succession and non-succession apply in different circumstances, based on the newly developed provisions. The purpose of the study is to identify the advantages and disadvantages of the proposed Articles as well as discuss whether there is a need for such rules at all, or are the existing legal rules enough.

Osservare l’evoluzione della legittima con gli occhi della scienza giuridica di Domat – le cui riflessioni costituiscono l’antecedente storico-sistematico del Code civil – non deve sembrare un mero esercizio di stile, in quanto l’ossequio alla cultura giuridica e alla radicata tradizione sottese alle regole della successione mortis causa sono imprescindibili per poter comprendere l’attuale posizione del legittimario, oggetto di rinnovato dibattito. Invero, il mutamento in atto dei rapporti familiari e la necessità di rispecchiare gli effettivi legami affettivi e solidaristici del de cuius, a prescindere da quelli di sangue, esigono un aggiornamento del sistema di successione necessaria.

L'analisi prende spunto dallo stato attuale della normativa in materia successoria per evidenziare quali siano e se vi siano cesure tra l'impostazione legale della materia e l'effettiva applicazione operativa. Comparando il sistema successorio italiano con quello inglese si è inteso evidenziare la contraddizione presente nel nostro ordinamento tra declamazioni e regole operative soprattutto in materia di "libertà testamentaria". In questa ottica si tenta di ricostruire la disciplina della successione testamentaria ancorandola anche al principio costituzionale della autonomia privata.

Dynamics of a Ferromagnetic Particle Levitated Over a Superconductor

Under conditions where the angular momentum of a ferromagnetic particle is dominated by intrinsic spin, applied torque is predicted to cause gyroscopic precession of the particle. If the particle is sufficiently isolated from the environment, a measurement of spin precession can potentially yield sensitivity to torque beyond the standard quantum limit. Levitation of a micron-scale ferromagnetic particle above a superconductor is a possible method of near frictionless suspension enabling observation of ferromagnetic particle precession and ultrasensitive torque measurements. Advocates for a social Europe are worried that the accession of ex-Eastern Bloc countries into the European Community would lead European corporations to emphasize a financial orientation rather than a societal orientation. We examined this question in a study of the values orientations of 3,836 managers in 16 countries representing established EU, new EU, and candidate EU country groups. Within-Europe managerial values convergence was found in a relatively high openness to change and low self-enhancement values. Coexistence of cryptic rotifer species: ecological and genetic characterisation of Brachionus plicatilis

SUMMARY 1. The coexistence of five cryptic species of the rotifer species complex Brachionus plicatilis was investigated in four coastal Mediterranean ponds. Monthly sampling was undertaken for 15 months and species were characterised using allozyme electrophoresis. 2.
