Harmonization of Insurance Supervisory Law
2015
This chapter addresses the fundamental issue of what degree of harmonization applies in the Solvency II system. Distinguishing among the several degrees of harmonization—minimum harmonization, maximum harmonization, and full harmonization—leads to the conclusion that the Solvency II Directive has full harmonization as its objective. This has two important ramifications: First, the Solvency II Directive requires that any insurance supervisory regime implementation by the respective national legislators must completely align with the European insurance supervisory regime. Second, a system of full harmonization prohibits national legislators from unilaterally enacting additional measures not p…

Latin Object and Subject Infinitive Clauses
2012
The paper is devoted to the theoretical and descriptive problems caused by Latin accusative with infinitive constructions. Latin infinitives can have an accusative subject also in constructions in which neither of the two conditions of accusative licensing by the matrix verb is satisfied: the matrix verb is intransitive, or the infinitive phrase is in subject or adjunct position, and furthermore, there is evidence of the infinitival clause also projhecting a CP - even if no visible complementizer is present. In Latin, the infinitive phrase is often coindexed with a third demonstrative pronoun, which allows the hypothesis that the infinitival CP (similar to an object that-clause) is base-gen…
Containment and intensification in political war : Carl Schmitt and the Clausewitzian heritage
2016
This article provides the first comprehensive and chronological analysis of Carl Schmitt’s reception of Carl von Clausewitz. While earlier scholarship has mostly stressed Schmitt’s shift from Clausewitzian ‘instrumentality’ to an ‘existential’ view of war, I note some inherent difficulties in this dichotomy and instead promote the parallel distinction between two argument types: those of containment and intensification. Schmitt theorized both limited political war and the intensification of war out of traditional bounds, and focusing on one should not eclipse the other. Further, both elements are identifiable already in Clausewitz. I analyse Schmitt’s oscillation between containment and int…
This, and This, and That
2021
More dependent clauses are discussed, and more surprising results emerge. The most important of these are that distinct clauses belonging to the same period can sometimes have an overlap, and that there are clauses that, though being neither interrogative nor imperative, are such that wondering about their truth value does not make sense.
European traditional tomatoes galore: a result of farmers' selection of a few diversity-rich loci
2022
A comprehensive collection of 1254 tomato accessions, corresponding to European traditional and modern varieties, early domesticated varieties, and wild relatives, was analyzed by genotyping by sequencing. A continuous genetic gradient between the traditional and modern varieties was observed. European traditional tomatoes displayed very low genetic diversity, with only 298 polymorphic loci (95% threshold) out of 64 943 total variants. European traditional tomatoes could be classified into several genetic groups. Two main clusters consisting of Spanish and Italian accessions showed higher genetic diversity than the remaining varieties, suggesting that these regions might be independent seco…
La natura delle cose
2022
The reference to the nature of things is still working today in legislation and jurisprudence. In this article the reasons for the persistence of this line of reasoning in law and in the legal science are examined. These reasons generally depend on the close connection between law and some fundamental social relations. But also the essential need to assure its effectiveness, without which law would be useless. In turn, the contemporary evolution of the legal culture requires a change in the way of understanding the nature of things. Nowadays, the nature of things distances itself from mere objectivism to get close to the deliberative character of the determination of the law
“Etymologia Est Origo Vocabulorum…”
1985
SUMMARYThe study wants to contribute to the explication of Isidore of Sevilla's conception of etymology starting with the definition "Etymologia est origo vocabulorum, cum vis verbi vel nominis per interpretationem colligitur" (Etym. I, xxix, 1). At first sight the problem of interpretation results from the contradiction between the static character of the principal clause (est origo) and the dynamic character of the subordinate clause (colligitur). This contradiction is resolved in favour of the dynamic aspect by changing origo into originatio on the basis of a teleological and historical interpretation. In a second step, an attempt has been made to arrive at a comprehensive assessment of …
