The present contribution begins with a preliminary analysis of the concept of “care”, before considering the dynamics of misrecognition of this fundamental dimension of the human condition. Peculiar attention will be devoted to the modalities in which this misrecognition has been translated into specific cultural, legal and social norms. Among the problems long debated by the scholars of the Greek Paraphrase of Justinian’s Institutes, the most interesting was the one concerning the legal sources used by Theophilus; they indeed are not identical with Justinian’s Institutes. Furthermore, a point of view prevails that claims the Antecessor – during the editing of his Paraphrase – could also have taken into consideration Gaius’ Institutes. Il testo sviluppa uno dei temi più cari all’autrice: le diverse declinazioni della libertà e il loro rapporto con la rivoluzione. Manca di data, ma, essendo presenti molti riferimenti all’attualità, è facile dedurre che esso sia stato scritto tra la fine del 1966 e il 1967. J.C. Maier – a previously known aide to Bluhme in the transcription of the Veronese palimpsest of Justinian’s Code. This paper calls into question the idea that in the summer of 1823 Maier worked together with Bluhme at the decipherment of the palimpsest of Gaius’ Institutes preserved in the Capitular Library of Verona (Verona, B. Cap., Cod. XV). A comprehensive analysis of the sources leads to the conclusion that Maier helped Bluhme in the same library for the transcription of the palimpsest of Justinians’ Code (Verona, B. L'articolo esamina il contributo della Corte europea dei diritti umani ai processi di transizione democratica con particolare attenzione ai Paesi dell'Est europeo. Dall'analisi della giurisprudenza della Corte non emerge una visione unitaria del concetto di "transizione democratica", che viene in rilievo talvolta come un fatto, altre volte come un valore. La stessa "transizione - valore", poi, non è concepita in temini unitari, dato che la democrazia può essere intesa come "aperta" o come "militante". Il contributo si propone, pertanto, di comprendere se nella giurisprudenza della Corte sia possibile riscontrare, se non altro, la ricerca di un punto di equilibrio tra queste diverse nozioni.
