Globalization of Monitoring Practices: The Case of American Influences on the Dismissal Risk of European CEOs

Accepted version of an article from the Journal of Economics and Business This study examines globalization of monitoring practices by focusing on how American (U.S.) influences on European firms impact the dismissal risk for these firms' CEOs. Specifically, we argue that the stronger short term orientation of the American corporate governance system increase the dismissal performance sensitivity faced by European CEOs, indirectly and directly. The former materializes via European firms cross-listing on U.S. exchanges, the latter results from European firms hiring U.S. independent board members. The journal Compositio Mathematica was founded by Luitzen E. J. Brouwer to counter his dismissal from the Mathematische Annalen in 1928. In spite of the economic crisis, Brouwer succeeded in finding a publisher (Noordhoff), an editorial board and subscribers. The founding took place at the time of the rise of the Third Reich, which caused problems of a political nature. The German editors followed Ludwig Bieberbach in 1934 when he left the board because Brouwer refused to dismiss the Jewish editors. The study aims to analyze a consequence of the annulment of the dismissal decision by the court, for reasons of lackluster or unlawfulness. According to art. 80 of the Labor Code, in the event of the finding of illegality and/or inadequacy of the dismissal decision, the court orders the cancellation of the unilateral act of dismissal. Nutrition care of cancer patients-A survey among physicians and nurses

In order to quantify gaps in the provision of medical nutrition care in Germany and pinpoint specific areas of need, we collected data from patients, nurses and physicians. The results from the patient survey were published separately. A total of 506 participants from 69 certified centers answered the questions developed in cooperation with representatives from different professional groups (physicians, nurses and dietitians). Only about a third of participants reported that their institution provides structured pathways to nutritional counseling. 70.1% of those physicians reported that there was a specialist in nutrition available at their center while only 55.8% of nurses agreed. Licenziamento e rideterminazione della sanzione disciplinare nel lavoro pubblico privatizzato

Il contributo, dopo un’analisi della disciplina sanzionatoria del licenziamento invalido nel pubblico impiego, prende in esame il nuovo art. 63, c. 2 bis, del D.lgs. n. 165/2001. La norma, che attribuisce al giudice il potere di rideterminare la sanzione in caso di difetto di proporzionalità, è oggi una peculiarità della disciplina del lavoro pubblico privatizzato. L’Autore ritiene che questa si ponga in controtendenza con le recenti riforme del lavoro in Italia, in quanto recupera importanti spazi alla discrezionalità giudiziale.

The rule which gives the judge the power to re-determine the sanction in case of lack of proportionality is today a peculiarity of the discipline of the public sector. The Author believes that this goes against the trend of recent labor reforms in Italy recovering important spaces for judicial discretion.
