Reflections about the authentic document in "post mortem" fecundation

[EN] The legislation on assisted reproduction contemplates the ¿post mortem¿ fecundation. Nevertheless, the document for the presentation of the assent raises some doubts in relation with the principle of party autonomy and the new technologies of the information and communication (ICTs). In the present work one thinks about these questions and one tries to contribute some solution of application in the Spanish legal system.

The reverse mortgage is a credit or loan guaranteed by a mortgage that falls on the applicant?s habitual residence, granted at once, or through periodic benefits, to a person who must be over a certain age or prove a degree of disability or dependency, and is not due until the time of death. In view of the doubts that the future of the public pension is raising and the concentration of savings in Spanish property, the reverse mortgage is once again being put on the table as a viable alternative to complement a public pension with little revaluation, in view of the increase in life expectancy and expenses after retirement.

Ha previsto la possibilità di impugnare una sentenza definitiva di assoluzione per omicidio o crimini internazionali, qualora – in base a nuovi fatti o mezzi di prova – emergano “ragioni stringenti” per una condanna. La riforma ha già sollecitato dubbi di legittimità costituzionale e, per la sua rilevanza, suscita varie riflessioni.

Il ruolo del white paper sulle offerte al pubblico di cripto-attività alla luce della proposta MiCA

La proposta MiCA, nel regolare il white paper sulle offerte di crypto-assets, sembra tenere in considerazione i benefici e i limiti dei sistemi di voluntary e di mandatory disclosure, non optando integralmente né per il primo, né per il secondo. In quest’ottica, se può condividersi l’approccio regolamentare diretto a graduare, a seconda della tipologia di token offerto, sia il contenuto che l’assoggettamento del documento a mera notifica o ad approvazione ex ante da parte dell’Autorità competente, dubbi sorgono in ordine all’indistinta allocazione dell’onere della prova in capo all’oblato, nei casi di violazione della disciplina del relativo white paper.

The MiCa proposal in the regular white paper on crypto-assets offerings seems to take into account the benefits and limitations of voluntary and mandatory disclosure systems not opting for either the former or the latter in full. On one hand one can agree with the regulatory approach aimed at adapting the content of the white paper to the type of token offered and at making the white paper either subject to mere notification or to the approval by the competent Authority depending on the asset offered. On the other hand doubts arise on the indistinct allocation of the burden of proof to the user in case of infringement of the relevant white paper framework.Settore IUS/04 - Diritto Commerciale

Ewangelista Jan zaprezentował w swoim dziele różne wymiary wiary w zmartwychwstałego Jezusa. Umiłowany uczeń uwierzył po zobaczeniu pustego grobu, w którym pozostały tylko płótna i chusta (J 20,8). Maria Magdalena uwierzyła po tym, jak przemówił do niej uwielbiony Chrystus, którego wcześniej pomyliła z ogrodnikiem (J 20,14-16). Uczniowie uwierzyli wówczas, gdy ujrzeli swego zmartwychwstałego Mistrza i Jego rany (J 20,20).
