Present Uncertainty and Looking to the Past: The Ambiguous Literary Nationalism of Putnam’s Monthly

2023

Putnam’s Monthly (1853-1857) was one of the best literary and general interest magazines in antebellum America. Besides its high quality, what made the New York-based magazine stand out was its commitment to publishing American writers and focusing on American themes at a time when, with no reliable international copyright protection in place, many periodicals in the United States were in the habit of reprinting the works of foreign (primarily British) authors, sometimes without payment. However, despite its optimistic literary nationalism, Putnam’s Monthly expressed uncertainty about the quality of contemporary American literature and, indeed, about the capacity of American society to enco…

Illuminismo e giustizia penale. Il caso della ghigliottina

2011

International audience; A mechanical daughter of the enlightenment, the guillotine remains a frightening symbol of its dialectic. Focusing on the texts and contexts of the institution of this lethal machine in the administration of justice, this article examines the anthropological sense and the political dimension of the recourse to the machine. Is the mechanization of capital punishment a step forward in the humanization of social relations or the entry in the era of technical inhumanity? In this ambigu…

European protection of fundamental rights in environmental matters. Contribution to the study of the relationship between law and science

2019

The prevention and sanction aspects of the protection against the pollution is manifested in Europe by the combination and complementarity of two matters (environment and fundamental rights) and two legal orders (European Union and Council of Europe). They consist of the protection of the environment that a person can expect to obtain in the context of the protection of these rights. They allow the management of "new risks" and the assimilation of pollution to a violation of a fundamental right under conditions including scientific knowledge. Protection of fundamental rights in environmental matters raises the question of the place given to scientific demonstration in jurisdictional work an…
