Language shapes reality, allowing the communication of ideas, theories and emotions through words. Through discourse, information is transferred and/or modified in the passages between addresser and addressee. In fact, the speaker may modify information in the transfer process by expressing commitment to the reality of his/her statement. This study investigates the expression of the indirect evidential subdomain in two languages in contact, i.e. the northern variety of Central Aymara and the variety of Spanish spoken in La Paz (Bolivia). Epistemic uses of the pretérito pluscuamperfecto in La Paz Spanish

This paper explores epistemic-evidential uses of the pluperfect, i.e. pretérito pluscuamperfecto, in La Paz Spanish. The pretérito pluscuamperfecto displays functions of a reported evidential form, conforming to results from previous studies on Argentinian Spanish (Bermúdez 2008; Speranza 2014) and, furthermore, is used according to a previously unnoticed inferential evidential function. Using theoretical frameworks from Kockelman (1957) and Bergqvist (2018), this paper describes the configuration of participant roles and event types implied in the different evidential functions of the pretérito pluscuamperfecto.

Problematyka prekluzji dowodowej w instancji odwoławczej wiąże się z zaprezento-waniem przedmiotowego zagadnienia w kontekście art. 427 § 3 k.p.k. w zw. z art. 452 k.p.k. Łączna interpretacja wskazanych przepisów pozwala wyprowadzić wnioski co do faktycznego zakresu obowiązywania prekluzji dowodowej w postępowaniu przed sądem II instancji i jego wpływu na model postępowania odwoławczego. Evidentiary proceedings before an appellate court in the Polish criminal trial

W artykule przedstawiono postępowanie dowodowe przed sądem odwoławczym. Analizując tę problematykę wskazano, iż zakres postępowania dowodowego prowadzonego przed sądem ad quem determinuje model postępowania odwoławczego. W apelacyjnym modelu postępowania odwoławczego kontrola zaskarżonego orzeczenia obejmuje uchybienia zarówno w zakresie prawa, jak i błędną ocenę ustaleń faktycznych oraz błędy przy wymiarze kary. W tym modelu sąd apelacyjny ponownie przeprowadza dowody i wydaje zupełnie nowy wyrok, bez możliwości uchylenia zaskarżonego wyroku i przekazania sprawy sądowi pierwszej instancji do ponownego rozpoznania.
