Introduction: Definition and Legal Sources

The aim of the contribution is to define the concept of international military operations to which the rules of humanitarian law apply. The work also offers a definition of the sending state and the host state of these operations. It also identifies the normative sources governing these phenomena: from international humanitarian law ("ius in bello") to human rights law, UN standards, the agreements on the status of the forces deployed, but also internal legal systems.

On the 3rd of May, the Rome Tribunal accepted the complaint lodged by the Ministry of Interior against the interim measure with which, last January, the same Court declared the illegitimacy of the procedure of migrants and asylum seekers informal readmission in Slovenia, because of the violation inter alia of the principle of non-refoulement. Despite the negative outcome for the asylum seekers, the order of the complaint did not refute the reasoning of the judge of the first instance who, for the first time, recognized the entry protection by issuing an urgent precautionary measure. This contribution challenges the idea of the existence of a one-size-fits-all rule that always prohibits or permits outside forcible intervention upon the request of a government engaged in a civil war. In this chapter the main issues concerning legal effects of international legal rules in domestic orders are examined in a systematic way. This investigation is underpinned by the following five pillars. First, the idea that States are not bound by international obligations in this respect. The question is whether, once a State has determined its baselines by a legislative or administrative act, these lines are fixed and will not be altered by any subsequent physical change due to the SLR. French Vaccine Pass to the Test of the Constitutional Council: Some Considerations in the Light of the European Convention on Human Rights

On 21 January 2022 the French Constitutional Council issued a ruling on the constitutionality of the law which aimed to make the access to a very large number of places subject to a vaccine pass. Firstly, the essay illustrates the main points of the ruling with a particular focus on the legal criteria which constituted the parameters used by the French Constitutional Council, including a short explanation of the legal provisions rejected. The article then analyses the most recent judgement of the European Court of Human Rights (ECtHR) which regarded mandatory vaccinations.
