The article discusses two main theses. The first one is the presence and forms of the rule of law in the international legal scenario. This task is developed through the analysis of three possible versions: the extension of the domestic rule of law to the obligations coming from international law, the rule of international law, and the international rule of law. The paper deals with the structural vagueness of the legal measures enacted by the Italian legislator to manage the Covid-19 pandemic. Can we demand more certain norms? Is personal liberty taken in due account by the legislator? Starting from these and similar questions, the paper proposes a reconstruction of the law and of the underlying legal ideology of contemporary constitutional States.

This paper offers a diachronic reconstruction of MacCormick’s theory of law and of legal argumentation; in particular, two connected points will be highlighted in which the difference between the perspective upheld in Legal Reasoning and Legal Theory and the later writings is particularly marked. The first point concerns MacCormick’s gradual break with legal positivism, and more specifically the thesis that the implicit pretension to justice of law proves legal positivism false in all its different versions. In this paper I try to revise Sen’s thesis about the «transcendental» nature of Rawls’ theory of justice. According to Sen transcendental theories of justice are unnecessary. What we aim at is to justify a series of comparative judgements about two or more states of affairs.We do not strive, unlike Rawls, to form a complete system of moral principles that backs an «ideal just society». I try to show that Sen’s «comparative» account is weak. First of all, Sen does not offer a fair interpretation of Rawls’ theory. Starting from the appellation of civitas splendidissima given by Cicero to Lilybaeum and from its relation with the juridical status of the Punic city after the Roman conquest, the aim of this paper is to reconstruct the topography of the town, with particular reference to the religious landscape. The most part of the data, as well as the information coming from epigraphy and numismatics concern the 2nd Century BC or, according with th common interpretation, the years in which Lilybaeum was under the control of Sextus Pompeus.
