The barratry of the shipmaster in early modern law: polysemy and mos Italicus

Summary ‘Barratry’ is a polysemic term: it means deceit, bribe, simony, and fraud of the shipmaster. This article seeks to trace the origins of the word and to explore its different meanings, focusing especially on the influence that older meanings had on the development of more recent ones. This operation is of particular importance to understand the meaning of barratry that would appear for last – that of fraud of the shipmaster. Hauptquellen der Untersuchung sind dabei die damaligen Fachzeitschriften und Protokolle von Juristentagungen. The shifting evocations of squadrismo: remembering the massacre of Palazzo d'Accursio in Fascist Bologna

The massacre of Palazzo d’Accursio is considered one of the first events in the rise of the Fascist squads. This article analyzes the ways in which the event was described in Bologna during the twenty years that followed it. It is believed that in the first few years, commemorations that emphasized the role of the Fascist squads were not very common. Instead, they concentrated on the life of Giulio Giordani, a murdered lawyer and opposition councilor, who became a martyr. This study is primarily concerned with the security of transactions and contracts in contexts in which there is more than one legal system - in bijural (or multijural) societies - and with the contribution that bijural lawyers can make to the security of transactions and contracts, that is with the productivity of bijural lawyers.
