Incomprensibilità e ironia. Filosofia e letteratura in Friedrcih Schlegel e Paul De Man
2019

The A. answer to a series of questions by the Director of the "Gruppo di Pisa" Journal. The questions concern the parliamentary procedure followed to enact the State Budget Law for the year 2023 (law No 197/2022). The A. debates over: the possibility to prove the evident violation of parliamentary privileges in the procedure followed by the two chambers of the Italian parliament (Const. court. orders Nos. 17/2019 and 60/2020); the impact of Next Generation EU and of NPRR over the National Budgetary procedures; the role played by the Budget Parliamentary Office (UPB) and by the State General Accounting Office in parliamentary procedures concerning the State Budget Law for the year 2023
Religious confession privilege in Italy
2021
In Italy, the secrecy of confession practised in some religious denominations and especially in the [Roman] Catholic Church, is widely recognised. Indeed, it is so widely recognised that it is not perceived as a particular concession to religion, even less as a privilege, but rather as a to religious freedom guaranteed by art 19 of the Constitution of the Italian (‘Italian Constitution’ or ‘Constitution’) which is a subjective and public right since it can be enforced against the state. In other words, this protection of religious belief and action in the Italian Constitution denies that the state may limit religious confession and the secrecy of that confession by law or administrative act…
2021
Policies adopted by the governance of the EMU during the financial and Covid crises display a clear gap between the “form” and the “substance” of the institutional architecture of title VIII of the TFEU. It is submitted that this architecture is in sharp contrast with the European constitutional tradition. Furthermore, the traditional view is rejected, according to which the EU Commission and Council, as well as the ECB, are devoid of binding powers in the field of economic policy. Some reflections concerning both methodological implications of the foregoing and its possible effects on the European integration process are finally developed
2023
The essay is part of a book that aims to rediscover and enhance Pierre Bourdieu's contribution to the legal philosophy. Clelia Bartoli's paper takes up the French sociologist's theory of the State outlined during courses held at the College de France in 1989/1990 and 1990/1992. Bourdieu eschewed an intellectual fashion of his time that pushed historians, political scientists, lawyers and sociologists to examine the causes and reasons, evolutions and epilogues of revolutions, at the expense, however, of what is happening on the background: the dull, muffled and repetitive order of things. Bourdieu believed that permanence more than change, what is obvious more than what is eccentric, the ord…

«IL GRANDE PAN (NON) È MORTO». LA LEGGENDA DELLA MORTE DI PAN DA PLUTARCO A D’ANNUNZIO
2016
In Plutarch’s De defectu oraculorum a mysterious voice announces to a ship’s helmsman that «the Great Pan is dead». This enigmatic legend gave rise to two different interpretations crossing the history of European literatures. The first, concerning ritualism and folklore, connects this episode to the death of vegetations’s God (Tammuz, Adonis) or of another demonic entity. According to the second, common in Christian authors, Pan is the same crucifix Jesus or, on the contrary, the paganism defeated by his death. Gabriele D’Annunzio overturns announcement’s meaning and proclaims that «the Great Pan is not dead».
