The Full Protection and Security Standard in Investment Law: A Specific Obligation?

2019

This chapter aims to demonstrate that full protection and security and fair and equitable treatment are two different standards that don’t apply under the same circumstances and have different legal status. After a historical overview (Sect. 1) intended to show how the conflation between the two has emerged over the centuries, emphasis is put on the nature and the scope of application of the full protection and security standard when compared to the fair and equitable treatment standard (Sects. 2 and 3). The next section of the current chapter introduces the idea that full protection and security is to be read in light of another provision often found in international investment agreements:…

The role of Doppler ultrasonography in determining the proper surgical approach to the management of varicocele in children and adolescents

2006

In a study from Italy, colour-Doppler ultrasonography was a reliable diagnostic tool in the preoperative assessment of patients with varicocele. The authors also found that it helped to distinguish those who could be treated laparoscopically from those who should be treated by microsurgical subinguinal ligature. OBJECTIVE To investigate whether colour Doppler ultrasonography (CDUS) is a reliable diagnostic tool for selecting patients with varicocele to undergo either laparoscopy or open microsurgical subinguinal ligation. PATIENTS AND METHODS In a 3-year period, 42 boys affected by left varicocele were evaluated before surgery by inguinal and scrotal CDUS. Using this method it was possible …

Paulson's Nomological Normativity

2013

In some of his recent work Stanley Paulson puts forward a number of important and ambitious exegetical claims about Hans Kelsen’s Pure Theory of Law. Some of these claims are not novel in Paulson’s rich Kelsenian corpus. But, taken together, these claims now amount to the main outlines of a fully-fledged interpretation of the theoretical foundations of the Pure Theory of Law. Paulson holds that (1) contrary to what Joseph Raz, Carlos S. Nino and many others have claimed, there is, in the Pure Theory of Law, no “justified normativity” thesis. Kelsenian normativity is, rather, “nomological” normativity. (2) ‘Validity’ is not, in the Pure Theory of Law, a matter of the reasons norm-subjects ma…

Safety and efficacy of intensity-modulated radiotherapy in the management of spermatic cord sarcoma.

2017

International audience; Purpose. - Spermatic cord sarcoma is a rare disease, which management remains controversial due to the lack of guidelines. The standard therapeutic approach is surgical: wide soft-tissue resection with radical inguinal orchidectomy, The diagnosis is made during the analysis of the specimen. The high rate of local recurrence indicates adjuvant radiotherapy of the tumor bed. The aim of this series is to determine the efficacy and safety of postoperative intensity-modulated radiotherapy for spermatic cord sarcomas. Patients and methods. - Our series included five consecutive cases of spermatic cord sarcoma treated between 2011 and 2014. The indications for radiotherapy …

In vivo confocal laser laparoscopy allows real time subsurface microscopy in animal models of liver disease.

2007

Background/Aims Histopathology is essential in the diagnostic workup of most liver diseases. However, biopsy sampling might carry risks, is subject to sampling error, and does not provide dynamic tissue imaging. Therefore a newly developed miniaturised confocal probe was evaluated for in vivo microscopic imaging in rodent models of human liver diseases. Methods The handheld laparoscopy probe used a 488nm single line laser for fluorophore excitation. Optical slice thickness was 7μm, lateral resolution 0.7μm. Imaging depth was 0–250μm below the tissue surface. Imaging using different fluorescent staining protocols was performed in healthy mice, IFNγ- and IL-12-induced hepatitis, after bile du…
