From sin to the civil order, unions outside of marriage under the law (XVI-XX century)

The aim of this thesis is to understand the legal status of unmarried couples, over a period of time extending for nearly five centuries. The canon law of marriage relegated cohabitation to a permanent state of sin, and in the sixteenth century, the council of Trent prescribed severe penalties to punish cohabitation. The fathers of the council enacted rules governing the celebration of marriage. Secular authority then gradually arrogated jurisdiction in matrimonial matters by means of laws and jurisprudence. This work sheds light on the representations of royal power that confronted each other until 1848 to fulfil the programme of reconciliation of the "two France" wanted by Louis XVIII. They are divided between the desire to return to the Ancien Régime and the attempt to renew the royal function. Opposed to the ultraroyalists, the supporters of this original path wished to consecrate liberal constitutionalism by resorting to an unexpected expedient, the power of the King, which had to be remodelled. While visitors were traditionally kept at arm's length, the use of these techniques now involves them at every stage in implementing the museum offer online. Support for culture via crowdfunding in question: beyond motivations, an analysis of the barriers to participate

In a context of strong budgetary pressure for non-market cultural organizations and of relative slowdown of crowdfunding campaigns in this sector, this reflection aims to provide a critical analysis of these new forms of financial support for culture. After drawing up a state of the art on the levers and obstacles to participation in such financing operations, the results of a qualitative study based on 43 individuals (donors and non-donors, familiar or not with cultural practices) will be exposed to highlight the diversity of misgivings about crowdfunding, beyond the traditional barriers attached to cultural gift, and the paradoxes that these calls for generosity arouse.
