Neil MacCormick’s Second Thoughts on Legal Reasoning and Legal Theory. A Defence of the Original View
2011
This paper offers a diachronic reconstruction of MacCormick’s theory of law and of legal argumentation; in particular, two connected points will be highlighted in which the difference between the perspective upheld in Legal Reasoning and Legal Theory and the later writings is particularly marked. The first point concerns MacCormick’s gradual break with legal positivism, and more specifically the thesis that the implicit pretension to justice of law proves legal positivism false in all its different versions. In brief, MacCormick uses the argument of the implicit pretension to justice of law against the thesis of the separability between law and morality and, accordingly, against legal posit…

The Italian version of the Cognitive Style Indicator and its association with decision-making preferences
2018
By adopting a more flexible view, Cools and Van den Broeck (2007) developed the Cognitive Style Indicator (CoSI) which includes three cognitive dimensions: Creating (flexible, open-ended and inventive), Knowing (emphasizing facts, details, objectivity, and rationality), and Planning (guided by preferences for certainty and well-structured information). The first aim of this research was to validate the three factor structure of the CoSI within the Italian context, whereas the second was to verify whether cognitive styles, as measured by the CoSI, accounted for individual differences in decision-making processes. Two studies were conducted using two different samples (n = 549 and n = 397). C…
Soggettività, identità, metafisica. Da Cartesio a Wittgenstein
2019
In recent articles I analysed the relationship between the proposals for a criti- que or “reformation” of metaphysics formulated according to the analytical and the continental points of view, underlining how in the former case there was an interest not so much in definitively dismissing metaphysics as in purifying it from obscure notions. In particular, I focussed on the way in which the notions of “totality” and “absolute” have been thoroughly reconsidered within a metaphysics that has been oriented towards a plane of scientific consistency. This essay aims to verify whether the notion of subjectivity could be considered another of the “great renunciations” on which many scholars of conte…
Dietrich von Hildebrand’s Criticism of Amoral Sex Education
2019
This article analyzes Dietrich von Hildebrand’s criticism of amoral sex education, which he regards as misleading and anti-educational in many crucial respects. Its content is misleading, because it separates human sexuality from its inherent connection with married love and thereby fails to do justice to the personal and intimate nature of sexuality. Its reductive and neutralizing approach not only fails to develop young people’s capacity for the transcendence implicit in moral agency, it also fails to provide the preconditions for the development of their authe-antic subjectivity. Instead of fostering objectivity, critical thinking and autonomy, amoral sex education promotes a normatively…
The Phenomenology of Between: An Intersubjective Epistemology for Psychological Science
2019
We outline the concept of intersubjective corroboration as an epistemology for psychological science. Psychological knowledge arises neither from subjectivity nor objectivity, but from intersubject...
Feminist Perspectives on Teaching Masculinities
2019
The chapter discusses the positive public role of gay and queer masculinities in their intersection with other identity configurations (class, race, and able-bodiedness). It presents an overview of the main perspectives on social construction and representation of homosexual masculinities within educational and academic settings using critical masculinities theory. While challenging homonormativity in research and education representations of the ‘rational man’ and ‘macho ethics’ of male researchers who ‘discover’, ‘conquer’ investigate ‘systematically’ or ‘rigorously’ are analyzed. Criticizing the play of inexpressiveness and emotionlessness objectivity as criterion of academic writing, re…

Thanks to 2,115 passive structures c…
