Second medical opinion in oncological setting
2021
Oncological patients increasingly require second medical opinions to feel more likely confident with their oncologists and treatments, although this could lead to wrong opinions and delay in the start of treatments. Second opinions can be required also by physicians to obtain advices, especially in case of rare tumors. The request of new opinions is documented in radiology and pathology settings too, with not negligible discrepancy rate. Conversely, the role in general medical/surgical conditions has not been well established. Literature is poor of studies relative to second opinions or they are more focused on patient's motivations. For these reasons, AIOM (Italian Association of Medical O…

Uno studio sulla “dissenting opinion” con particolare riguardo all’esperienza del diritto inglese
2023
The essay explores the many means through which judicial dissent has traditionally made its way into the English legal system in order to be finally accepted as an ineliminable instrument that the minority has availed itself of to air its differing opinion, mostly in matters of general, public importance. So, the research is in the first place directed towards the identification of the different types of dissent and of the forms (even concurring) in which it may be shaped. Furthermore, the study involves the attempt to find out what reasons may underlie the expression of dissent and whether they may conceal some kind of idyiosincratic state of mind on the part of the dissenters. A view is a…
Investment Arbitration and the Controverted Right of the Arbitrator to Issue a Separate or Dissenting Opinion
2018
Abstract Although dissents are not generally encouraged in international arbitration, they are a reality of investment treaty disputes. About one in five cases includes at least one separate or dissenting opinion. The ICSID Convention is rare among investment arbitration rules to expressly recognise the right of the arbitrator to attach his or her personal opinion to the award. Other investment arbitration rules are silent on the topic. And yet dissenting opinions are an established feature of several international courts and tribunals and their role is often viewed more benevolently than in investment arbitration. The article explores the perceived advantages and disadvantages of dissents …
Specificità femminili e maschili. Opinioni e aspettative di insegnanti di scuola secondaria di primo e secondo grado
2017

2022
Separate opinions have made the object of extensive scholarship in recent decades: in the international legal order, this is a consequence of that institution’s peculiar success, as virtually all judiciary and quasi-judiciary bodies allow for the allegation of separate opinions (either concurring or dissenting) to their rulings. This contribution tests the impact of separate opinions on subsequent case law and opinions, on the process of international law-making, and eventually on the mechanisms through which the Italian legal order adapts to international law as interpreted by international judiciary or quasi-judiciary bodies. The practice under scrutiny is admittedly multifarious; yet, it…
