Der Gaius der Preußen

2011

The discovery of the Palimpsest of the Gaius' Institutions in 1816 occurred at the height of palimpsest research and is part of a broader controversy among German and Italian scholars at that time. The deciphering of the lower stratum of the palimpsest and its first publication was supported by the Preußische Akademie der Wissenschaften and was considered as a product of German intellectual spirit. The transcriptions were transferred to the Akademie der Wissenschaften and later to the Königliche Bibliothek of Berlin. Today they are preserved in the Staatsbibliothek zu Berlin. They still constitute an indispensable basis for the constitutio textus of Gaius' Institutions.

Condictio e causa actionis

2014

Since the publication of Julius Baron’s book about the condictiones in 1881, the condictio of the Roman formulary procedure is considered as an ‘abstract’ action. In Baron’s opinion this peculiar nature was due to the fact that its formula never mentioned – and could not mention – the basis of the claim neither in its intentio, nor in a demonstratio, nor in a praescriptio. By considering the two formulae of condictio certae pecuniae recorded in TPSulp. 31, this paper focuses on the concept of causa actionis in order to call into question the gospel of the ‘abstractness’ of the formular condictio. A new analysis of the sources leads to the conclusion that in the formulary procedure the condi…

Ricerche sulla 'praescriptio'

2008

VII. 175 translated into Italian, concerning the transcript of a hearing conducted in front of Arsinoite’s σύνδικος in A.D. 339, and known in the field of doctrine as it cites a Constantine’s constitution regarding the longissimi temporis praescriptio. After reconstructing the trial and the early events preceding the lawsuit, defining the trial roles and detecting the nature of action and the reason why it was filed, the author has analysed the different juridical profiles of the text such as the evidence of the judicial function of the ἐπάρχος τῆς Αἰγύπτου; the judgemental function of the σύνδικος and the difficulty of identifying him as the…
