La proporzionalità tra il credito vantato e la garanzia che lo assiste, consente, attraverso l’espediente dell’abuso del diritto, l’estensione della tutela del debitore gravato da un’iscrizione ipotecaria eccessiva, che pertanto non si esaurisce nella riduzione codicistica dell’iscrizione ipotecaria o nella speciale responsabilità processuale del creditore prevista dall’art. 96 c.p.c., ma può esprimersi anche attraverso la responsabilità aquiliana del creditore. La soluzione, apprezzabile sotto taluni aspetti, si espone tuttavia a qualche perplessità, come quelle che ricadono sull’aggravio in capo al creditore dell’onere di accertamento estimativo del patrimonio debitorio.

Dry chlorination of spent nickel metal hydride battery waste for water leaching of battery metals and rare earth elements

An efficient leaching process was developed for nickel, cobalt, and the rare earth elements (REEs) from spent nickel metal hydride (NiMH) battery waste. The process involves dry chlorination with ammonium chloride in low temperature to produce water-soluble chlorinated compounds, followed by simple water leaching. The factors affecting the conversion and solubilization were studied, including the amount of ammonium chloride, residence time and temperature in dry chlorination, and solid to liquid ratio, time and temperature in water leaching. Does predictability matter? Effects of cue predictability on neurocognitive mechanisms underlying prospective memory

Prospective memory (PM) represents the ability to successfully realize intentions when the appropriate moment or cue occurs. In this study, we used event-related potentials (ERPs) to explore the impact of cue predictability on the cognitive and neural mechanisms supporting PM. Participants performed an ongoing task and, simultaneously, had to remember to execute a pre-specified action when they encountered the PM cues. The occurrence of the PM cues was predictable (being signalled by a warning cue) for some participants and was completely unpredictable for others. Single Event Upsets Induced by Direct Ionization from Low-Energy Protons in Floating Gate Cells

Floating gate cells in advanced NAND Flash memories, with single-level and multi-level cell architecture, were exposed to low-energy proton beams. The first experimental evidence of single event upsets by proton direct ionization in floating gate cells is reported. The dependence of the error rate versus proton energy is analyzed in a wide energy range. Proton direct ionization events are studied and energy loss in the overlayers is discussed. The threshold LET for floating gate errors in multi-level and single-level cell devices is modeled and technology scaling trends are analyzed, also discussing the impact of the particle track size. peerReviewed
