The well known judgment of the German Constitutional Court in the “Weiss” case has been widely criticized under EU law, mainly because of its being in contrast with a preliminary ruling rendered by the European Court of Justice in 2018. the paper assesses the widespread use of the test of proportionality in fundamental rights adjudication. While constitutional and human rights courts all over the world appear to be consistently engaged in deploying the test of proportionality in order to assess the permissibility of a given rights limitation, this approach is under severe criticism insofar as it is considered an attack to the very idea of fundamental rights. The paper will discuss this criticism of the use of proportionality, and will provide a defense of its use by courts in light of some basic features of the contemporary discourse of fundamental rights.

The p16INK4a gene, localized within chromosome 9p21, has been identified as a cyclin-dependent kinase inhibitor and may negatively regulate the cell cycle acting as a tumor suppressor. Genetic alterations involving the 9p21 region are common in human cancers. A consecutive series of 64 untreated patients (median of follow up 53 months) undergoing surgical resection for locally advanced laryngeal squamous-cell carcinomas (LSCCs) has been studied prospectively. The association of uric acid with mortality modifies at old age: data from the uric acid right for heart health (URRAH) study

Objectives: In older individuals, the role of serum uric acid (SUA) as risk factor for mortality is debated. This study investigated the association of SUA with all-cause and cardiovascular (CV) mortality in older adults participating in the large multicentre observational uric acid right for heart health (URRAH) study. Methods: Eight thousand URRAH participants aged 65+ were included in the analysis. The predictive role of SUA was assessed using Cox regression models stratified according to the cut-off age of 75. A Proposal to estimate the roaming–dog Total in an urban area through a PPSWOR spatial sampling with sample size greater than two

Settore SECS-S/05 - Statistica SocialeDogs roaming in urban areas constitute an issue for public order hygiene and health. Proper planning of actions for health and security control and allocation of financial funds require the knowledge of the roaming–dog–population size in a given urban area. Unfortunately a reliable statistical procedure aimed to measure such population is not available yet in literature. This paper presents a simple reproducible survey sampling procedure to estimate the number of roaming dogs in an urban area through the description of a real study carried out on a restricted area of the city of Palermo in southern Italy. A sample of areas is drawn by means of a drawn–by–drawn spatial sampling with probabilities proportional to size and without replacement (PPSWOR). As inclusion probabilities are not available in closed form they are estimated by Monte Carlo approach which is of simple implementation and permits design–based variance estimation even when first–order inclusion probabilities are unknown.

What keeps young adults in permanent poverty? A comparative analysis using ECHP

Abstract Previous studies suggest that there are strong differences in the rates of youth poverty across European countries. Rather surprisingly, it is found to be high in Scandinavian countries, and relatively speaking, lower in Mediterranean and Anglo-Saxon countries. This somewhat unexpected finding prompts the question whether the incidence of poverty is an appropriate measure of youth disadvantage.
